The GPL requiresthat for anyOpen Source Software covered under the GPL, which isdistributed to someone in an executable binaryformat, that the source code also be made available to those users. For anyOpen Source Software covered under the GPL, the source code ismade available on thisCD or download package. If anyOpen Source Software licensesrequire that Fortinet provide rightsto use, copyor modifyanyOpen Source Software program that are broader than the rightsgranted in thisagreement, then such rightsshalltake precedence over the rightsand restrictionsherein. Fortinet willprovide, for a charge reflecting our standard distribution costs, the complete machine-readable copyof the modified software modules. TERMS AND CONDITIONSFOR COPYING, DISTRIBUTION AND MODIFICATION ThisLicense appliesto anyprogram or other workwhich containsa notice placed bythe copyright holder saying it maybe distributed under the termsof thisGeneralPublic License. The “Program”, below, refersto anysuch program or work, and a “workbased on the Program” means either the Program or anyderivative workunder copyright law: that isto say, a workcontaining the Program or a portion of it, either verbatim or with modificationsand/or translated into another language. (Hereinafter, translation isincluded without limitation in the term “modification”.) Each licensee isaddressed as”you”. Activitiesother than copying, distribution and modification are not covered bythisLicense; theyare outside itsscope. The act of running the Program isnot restricted, and the output from the Program iscovered onlyif itscontentsconstitute a workbased on the Program (independent of having been made byrunning the Program). Whether that istrue dependson what the Program does. 1. You maycopyand distribute verbatim copiesof the Program’ssource code asyou receive it, in anymedium, provided that you conspicuously and appropriatelypublish on each copyan appropriate copyright notice and disclaimer of warranty; keep intact allthe noticesthat refer to this
26

License and to the absence of anywarranty; and give anyother recipientsof the Program a copyof thisLicense along with the Program. You maycharge a fee for the physicalact of transferring a copy, and you mayat your option offer warrantyprotection in exchange for a fee. 2. You maymodifyyour copyor copiesof the Program or anyportion of it, thusforming a workbased on the Program, and copyand distribute such modificationsor workunder the termsof Section 1 above, provided that you also meet allof these conditions: a) You must cause the modified filesto carryprominent noticesstating that you changed the filesand the date of anychange. b) You must cause anyworkthat you distribute or publish, that in whole or in part containsor isderived from the Program or anypart thereof, to be licensed asa whole at no charge to allthird partiesunder the termsof thisLicense. c) If the modified program normallyreadscommandsinteractivelywhen run, you must cause it, when started running for such interactive use in the most ordinaryway, to print or displayan announcement including an appropriate copyright notice and a notice that there isno warranty(or else, saying that you provide a warranty) and that usersmayredistribute the program under these conditions, and telling the user how to view a copyof thisLicense. (Exception: if the Program itself isinteractive but doesnot normallyprint such an announcement, your workbased on the Program isnot required to print an announcement.) These requirementsapplyto the modified workasa whole. If identifiable sectionsof that workare not derived from the Program, and can be reasonablyconsidered independent and separate worksin themselves, then thisLicense, and itsterms, do not applyto those sectionswhen you distribute them asseparate works. But when you distribute the same sectionsaspart of a whole which isa workbased on the Program, the distribution of the whole must be on the termsof thisLicense, whose permissionsfor other licenseesextend to the entire whole, and thusto each and everypart regardlessof who wrote it.. Thus, it isnot the intent of thissection to claim rightsor contest your rightsto workwritten entirelybyyou; rather, the intent isto exercise the right to controlthe distribution of derivative or collective worksbased on the Program. In addition, mere aggregation of another worknot based on the Program with the Program (or with a workbased on the Program) on a volume of a storage or distribution medium doesnot bring the other workunder the scope of thisLicense. 3. You maycopyand distribute the Program (or a workbased on it, under Section 2) in object code or executable form under the termsof Sections1 and 2 above provided that you also do one of the following: a) Accompanyit with the complete corresponding machine-readable source code, which must be distributed under the termsof Sections1 and 2 above on a medium customarilyused for software interchange; or, b) Accompanyit with a written offer, valid for at least three years, to give anythird party, for a charge no more than your cost of physically performing source distribution, a complete machine-readable copyof the corresponding source code, to be distributed under the termsof Sections1 and 2 above on a medium customarilyused for software interchange; or, c) Accompanyit with the information you received asto the offer to distribute corresponding source code. (Thisalternative isallowed onlyfor noncommercialdistribution and onlyif you received the program in object code or executable form with such an offer, in accord with Subsection b above.) Source code for a workmeansthe preferred form of the workfor making modificationsto it. For an executable work, complete source code meansallthe source code for allmodulesit contains, plusanyassociated interface definition files, plusthe scriptsused to controlcompilation and installation of the executable. However, asa specialexception, the source code distributed need not include anything that isnormallydistributed (in either source or binaryform) with the major components(compiler, kernel, and so on) of the operating system on which the executable runs, unlessthat component itself accompaniesthe executable. If distribution of executable or object code ismade byoffering accessto copyfrom a designated place, then offering equivalent accessto copythe source code from the same place countsasdistribution of the source code, even though third partiesare not compelled to copythe source along with the object code. 4. You maynot copy, modify, sublicense, or distribute the Program except asexpresslyprovided under thisLicense. Anyattempt otherwise to copy, modify, sublicense or distribute the Program isvoid, and willautomaticallyterminate your rightsunder thisLicense. However, partieswho have received copies, or rights, from you under thisLicense willnot have their licensesterminated so long assuch partiesremain in full compliance. 5. You are not required to accept thisLicense, since you have not signed it. However, nothing else grantsyou permission to modifyor distribute the Program or itsderivative works. These actionsare prohibited bylaw if you do not accept thisLicense. Therefore, bymodifying or distributing the Program (or anyworkbased on the Program), you indicate your acceptance of thisLicense to do so, and allitstermsand conditionsfor copying, distributing or modifying the Program or worksbased on it. 6. Each time you redistribute the Program (or anyworkbased on the Program), the recipient automaticallyreceivesa license from the original licensor to copy, distribute or modifythe Program subject to these termsand conditions. You maynot impose anyfurther restrictionson the recipients’ exercise of the rightsgranted herein. You are not responsible for enforcing compliance bythird partiesto thisLicense.. 7. If, asa consequence of a court judgment or allegation of patent infringement or for anyother reason (not limited to patent issues), conditions are imposed on you (whether bycourt order, agreement or otherwise) that contradict the conditionsof thisLicense, theydo not excuse you from the conditionsof thisLicense. If you cannot distribute so asto satisfysimultaneouslyyour obligationsunder thisLicense and anyother pertinent
27

obligations, then asa consequence you maynot distribute the Program at all. For example, if a patent license would not permit royalty-free redistribution of the Program byallthose who receive copiesdirectlyor indirectlythrough you, then the onlywayyou could satisfyboth it and this License would be to refrain entirelyfrom distribution of the Program. If anyportion of thissection isheld invalid or unenforceable under anyparticular circumstance, the balance of the section isintended to apply and the section asa whole isintended to applyin other circumstances. It isnot the purpose of thissection to induce you to infringe anypatentsor other propertyright claimsor to contest validityof anysuch claims; this section hasthe sole purpose of protecting the integrityof the free software distribution system, which isimplemented bypublic license practices. Manypeople have made generouscontributionsto the wide range of software distributed through that system in reliance on consistent application of that system; it isup to the author/donor to decide if he or she iswilling to distribute software through anyother system and a licensee cannot impose that choice. Thissection isintended to make thoroughlyclear what isbelieved to be a consequence of the rest of thisLicense. 8. If the distribution and/or use of the Program isrestricted in certain countrieseither bypatentsor bycopyrighted interfaces, the originalcopyright holder who placesthe Program under thisLicense mayadd an explicit geographicaldistribution limitation excluding those countries, so that distribution ispermitted onlyin or among countriesnot thusexcluded. In such case, thisLicense incorporatesthe limitation asif written in the body of thisLicense. 9. The Free Software Foundation maypublish revised and/or new versionsof the GeneralPublic License from time to time. Such new versionswill be similar in spirit to the present version, but maydiffer in detailto addressnew problemsor concerns. Each version isgiven a distinguishing version number. If the Program specifiesa version number of thisLicense which appliesto it and “anylater version”, you have the option of following the termsand conditionseither of that version or of anylater version published bythe Free Software Foundation. If the Program doesnot specifya version number of thisLicense, you maychoose anyversion ever published bythe Free Software Foundation. 10. If you wish to incorporate partsof the Program into other free programswhose distribution conditionsare different, write to the author to ask for permission. For software which iscopyrighted bythe Free Software Foundation, write to the Free Software Foundation; we sometimesmake exceptionsfor this. Our decision willbe guided bythe two goalsof preserving the free statusof allderivativesof our free software and of promoting the sharing and reuse of software generally.
NO WARRANTY 11. BECAUSE THE PROGRAM IS LICENSED FREE OF CHARGE, THERE IS NO WARRANTYFOR THE PROGRAM, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE STATED IN WRITING THE COPYRIGHT HOLDERSAND/OR OTHER PARTIESPROVIDE THE PROGRAM “AS IS” WITHOUT WARRANTYOF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIESOF MERCHANTABILITYAND FITNESSFOR A PARTICULAR PURPOSE. THE ENTIRE RISKAS TO THE QUALITYAND PERFORMANCE OF THE PROGRAM IS WITH YOU. SHOULD THE PROGRAM PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARYSERVICING, REPAIR OR CORRECTION.
12. IN NO EVENT UNLESSREQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MAY MODIFYAND/OR REDISTRIBUTE THE PROGRAM AS PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGESARISING OUT OF THE USE OR INABILITYTO USE THE PROGRAM (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSESSUSTAINED BY YOU OR THIRD PARTIESOR A FAILURE OF THE PROGRAM TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITYOF SUCH DAMAGES.

TERMS AND CONDITIONSFOR COPYING, DISTRIBUTION AND MODIFICATION 0. ThisLicense Agreement appliesto anysoftware libraryor other program which containsa notice placed bythe copyright holder or other authorized partysaying it maybe distributed under the termsof thisLesser GeneralPublic License (also called “thisLicense”). Each licensee is addressed as”you”. A “library” meansa collection of software functionsand/or data prepared so asto be convenientlylinked with application programs(which use some of those functionsand data) to form executables.
28

The “Library”, below, refersto anysuch software libraryor workwhich hasbeen distributed under these terms. A “workbased on the Library” meanseither the Libraryor anyderivative workunder copyright law: that isto say, a workcontaining the Libraryor a portion of it, either verbatim or with modificationsand/or translated straightforwardlyinto another language. (Hereinafter, translation isincluded without limitation in the term “modification”.) “Source code” for a workmeansthe preferred form of the workfor making modificationsto it. For a library, complete source code meansallthe source code for allmodulesit contains, plusanyassociated interface definition files, plusthe scriptsused to controlcompilation and installation of the library. Activitiesother than copying, distribution and modification are not covered bythisLicense; theyare outside itsscope. The act of running a program using the Libraryisnot restricted, and output from such a program iscovered onlyif itscontentsconstitute a workbased on the Library (independent of the use of the Libraryin a toolfor writing it). Whether that istrue dependson what the Librarydoesand what the program that usesthe Librarydoes.

  1. You maycopyand distribute verbatim copiesof the Library’scomplete source code asyou receive it, in anymedium, provided that you conspicuouslyand appropriatelypublish on each copyan appropriate copyright notice and disclaimer of warranty; keep intact allthe notices that refer to thisLicense and to the absence of anywarranty; and distribute a copyof thisLicense along with the Library. You maycharge a fee for the physicalact of transferring a copy, and you mayat your option offer warrantyprotection in exchange for a fee. 2. You maymodifyyour copyor copiesof the Libraryor anyportion of it, thusforming a workbased on the Library, and copyand distribute such modificationsor workunder the termsof Section 1 above, provided that you also meet allof these conditions: a) The modified workmust itself be a software library. b) You must cause the filesmodified to carryprominent noticesstating that you changed the filesand the date of anychange. c) You must cause the whole of the workto be licensed at no charge to allthird partiesunder the termsof thisLicense. d) If a facilityin the modified Libraryrefersto a function or a table of data to be supplied byan application program that usesthe facility, other than asan argument passed when the facilityisinvoked, then you must make a good faith effort to ensure that, in the event an application doesnot supplysuch function or table, the facilitystilloperates, and performswhatever part of itspurpose remainsmeaningful. These requirementsapplyto the modified workasa whole. If identifiable sectionsof that workare not derived from the Library, and can be reasonablyconsidered independent and separate worksin themselves, then thisLicense, and itsterms, do not applyto those sectionswhen you distribute them asseparate works. But when you distribute the same sectionsaspart of a whole which isa workbased on the Library, the distribution of the whole must be on the termsof thisLicense, whose permissionsfor other licenseesextend to the entire whole, and thusto each and everypart regardlessof who wrote it. Thus, it isnot the intent of thissection to claim rightsor contest your rightsto workwritten entirelybyyou; rather, the intent isto exercise the right to controlthe distribution of derivative or collective worksbased on the Library. In addition, mere aggregation of another worknot based on the Librarywith the Library(or with a workbased on the Library) on a volume of a storage or distribution medium doesnot bring the other workunder the scope of thisLicense. 3. You mayopt to applythe termsof the ordinaryGNU GeneralPublic License instead of thisLicense to a given copyof the Library. To do this, you must alter allthe noticesthat refer to thisLicense, so that theyrefer to the ordinaryGNU GeneralPublic License, version 2 instead of to this License. (If a newer version than version 2 of the ordinaryGNU GeneralPublic License hasappeared, then you can specifythat version instead if you wish.) Do not make anyother change in these notices. Once thischange ismade in a given copy, it isirreversible for that copy, so the ordinaryGNU GeneralPublic License appliesto allsubsequent copiesand derivative worksmade from that copy. Thisoption isusefulwhen you wish to copypart of the code of the Libraryinto a program that is not a library. 4. You maycopyand distribute the Library(or a portion or derivative of it, under Section 2) in object code or executable form under the termsof Sections1 and 2 above provided that you accompanyit with the complete corresponding machine-readable source code, which must be distributed under the termsof Sections1 and 2 above on a medium customarilyused for software interchange. If distribution of object code ismade byoffering accessto copyfrom a designated place, then offering equivalent accessto copythe source code from the same place satisfiesthe requirement to distribute the source code, even though third partiesare not compelled to copythe source along with the object code. 5. A program that containsno derivative of anyportion of the Library, but isdesigned to workwith the Librarybybeing compiled or linked with it, is called a “workthat usesthe Library”. Such a work, in isolation, isnot a derivative workof the Library, and therefore fallsoutside the scope of this License. However, linking a “workthat usesthe Library” with the Librarycreatesan executable that isa derivative of the Library(because it contains portionsof the Library), rather than a “workthat usesthe library”. The executable istherefore covered bythisLicense. Section 6 statestermsfor distribution of such executables. When a “workthat usesthe Library” usesmaterialfrom a header file that ispart of the Library, the object code for the workmaybe a derivative workof the Libraryeven though the source code isnot.
    29

Whether thisistrue isespeciallysignificant if the workcan be linked without the Library, or if the workisitself a library. The threshold for thisto be true isnot preciselydefined bylaw. If such an object file usesonlynumericalparameters, data structure layoutsand accessors, and smallmacrosand smallinline functions(ten lines or lessin length), then the use of the object file isunrestricted, regardlessof whether it islegallya derivative work. (Executablescontaining this object code plusportionsof the Librarywillstillfallunder Section 6.) Otherwise, if the workisa derivative of the Library, you maydistribute the object code for the workunder the termsof Section 6. Anyexecutablescontaining that workalso fallunder Section 6, whether or not theyare linked directlywith the Libraryitself. 6. Asan exception to the Sectionsabove, you mayalso combine or linka “workthat usesthe Library” with the Libraryto produce a work containing portionsof the Library, and distribute that workunder termsof your choice, provided that the termspermit modification of the workfor your own use and reverse engineering for debugging such modifications. You must give prominent notice with each copyof the workthat the Libraryisused in it and that the Libraryand itsuse are covered bythisLicense. You must supplya copyof thisLicense. If the workduring execution displayscopyright notices, you must include the copyright notice for the Libraryamong them, aswellasa reference directing the user to the copy of thisLicense. Also, you must do one of these things: a) Accompanythe workwith the complete corresponding machine-readable source code for the Libraryincluding whatever changeswere used in the work(which must be distributed under Sections1 and 2 above); and, if the workisan executable linked with the Library, with the complete machine-readable “workthat usesthe Library”, asobject code and/or source code, so that the user can modifythe Libraryand then relinkto produce a modified executable containing the modified Library. (It isunderstood that the user who changesthe contentsof definitions filesin the Librarywillnot necessarilybe able to recompile the application to use the modified definitions.) b) Use a suitable shared librarymechanism for linking with the Library. A suitable mechanism isone that (1) usesat run time a copyof the library alreadypresent on the user’scomputer system, rather than copying libraryfunctionsinto the executable, and (2) willoperate properlywith a modified version of the library, if the user installsone, aslong asthe modified version isinterface-compatible with the version that the workwas made with. c) Accompanythe workwith a written offer, valid for at least three years, to give the same user the materialsspecified in Subsection 6a, above, for a charge no more than the cost of performing thisdistribution. d) If distribution of the workismade byoffering accessto copyfrom a designated place, offer equivalent accessto copythe above specified materialsfrom the same place. e) Verifythat the user hasalreadyreceived a copyof these materialsor that you have alreadysent thisuser a copy. For an executable, the required form of the “workthat usesthe Library” must include anydata and utilityprogramsneeded for reproducing the executable from it. However, asa specialexception, the materialsto be distributed need not include anything that isnormallydistributed (in either source or binaryform) with the major components(compiler, kernel, and so on) of the operating system on which the executable runs, unless that component itself accompaniesthe executable. It mayhappen that thisrequirement contradictsthe license restrictionsof other proprietary librariesthat do not normallyaccompanythe operating system. Such a contradiction meansyou cannot use both them and the Librarytogether in an executable that you distribute. 7. You mayplace libraryfacilitiesthat are a workbased on the Libraryside-by-side in a single librarytogether with other libraryfacilitiesnot covered bythisLicense, and distribute such a combined library, provided that the separate distribution of the workbased on the Libraryand of the other libraryfacilitiesisotherwise permitted, and provided that you do these two things: a) Accompanythe combined librarywith a copyof the same workbased on the Library, uncombined with anyother libraryfacilities. Thismust be distributed under the termsof the Sectionsabove. b) Give prominent notice with the combined libraryof the fact that part of it isa workbased on the Library, and explaining where to find the accompanying uncombined form of the same work. 8. You maynot copy, modify, sublicense, linkwith, or distribute the Libraryexcept asexpresslyprovided under thisLicense. Anyattempt otherwise to copy, modify, sublicense, linkwith, or distribute the Libraryisvoid, and willautomaticallyterminate your rightsunder thisLicense. However, partieswho have received copies, or rights, from you under thisLicense willnot have their licensesterminated so long assuch partiesremain in full compliance. 9. You are not required to accept thisLicense, since you have not signed it. However, nothing else grantsyou permission to modifyor distribute the Libraryor itsderivative works. These actionsare prohibited bylaw if you do not accept thisLicense. Therefore, bymodifying or distributing the Library(or anyworkbased on the Library), you indicate your acceptance of thisLicense to do so, and allitstermsand conditionsfor copying, distributing or modifying the Libraryor worksbased on it. 10. Each time you redistribute the Library(or anyworkbased on the Library), the recipient automaticallyreceivesa license from the original licensor to copy, distribute, linkwith or modifythe Librarysubject to these termsand conditions. You maynot impose anyfurther restrictionson the recipients’ exercise of the rightsgranted herein. You are not responsible for enforcing compliance bythird partieswith thisLicense.
30

11. If you cannot distribute so asto satisfysimultaneouslyyour obligationsunder thisLicense and anyother pertinent obligations, then asa consequence you maynot distribute the Libraryat all. For example, if a patent license would not permit royalty-free redistribution of the Librarybyallthose who receive copiesdirectlyor indirectlythrough you, then the onlywayyou could satisfyboth it and this License would be to refrain entirelyfrom distribution of the Library. If anyportion of thissection isheld invalid or unenforceable under anyparticular circumstance, the balance of the section isintended to apply, and the section asa whole isintended to applyin other circumstances. It isnot the purpose of thissection to induce you to infringe anypatentsor other propertyright claimsor to contest validityof anysuch claims; this section hasthe sole purpose of protecting the integrityof the free software distribution system which isimplemented bypublic license practices. 12.
