INSPECTION

Carefully unpack and inspect your new ProTeam vacuum for shipping damage. Each unit is tested and thoroughly inspected before shipping. For instructions regarding any shipping damage, contact ProTeam immediately (866.888.2168). All returns must have a Return Authorization Number (RAN).
This manual has important information for the use and safe operation of the vacuum cleaners. Read this manual carefully before starting the machine. Keep this manual available at all times and instruct all operators to read this manual. If instructions are not followed, an injury may occur or equipment, furniture, or other property may become damaged.
The contents of this manual are based on the latest product information available at the time of publication. ProTeam reserves the right to make changes or improvements to its machines or components without notice.
The products described in this manual are intended for commercial use.

IMPORTANT SAFETY INSTRUCTIONS

When using an electrical appliance, basic precautions should always be followed, including the following.

Vacuum Safety:

Read Owner’s Manual before using this product. Failure to do so can result in serious injury or death.
To reduce the risk of fire, electric shock, or injury

  1. Use only as described in this manual. Use only the recommended attachments, battery pack, charger, and replacement parts.

  2. DO NOT use the vacuum outdoors or on wet surfaces. DO NOT expose to rain or water.

  3. DO NOT use or store vacuum in wet or moist conditions.

  4. DO NOT try to recover any liquid with this vacuum. This vacuum is for DRY RECOVERY only.

  5. DO NOT USE A DAMAGED VACUUM. If the unit is not working as it should, or if it has been damaged, left outdoors, or exposed to water, take it to an authorized ProTeam Warranty Station for inspection and repair.

  6. This vacuum is not intended for use by persons (including children) with reduced physical, sensory, or mental capabilities, or lack of experience and knowledge, unless they have been given supervision or instruction concerning use of the vacuum by a person responsible for their safety.

  7. DO NOT allow the vacuum to be used as a toy. Pay close attention when using the vacuum near children.

  8. DO NOT handle the switch or battery pack with wet hands.

    Violation of any of these instructions may void any and all warranties.

  9. DO NOT put any objects into openings. DO NOT use with any opening blocked; keep free of dust, lint, hair, and anything that may reduce air flow.

  10. Keep hair, loose clothing, fingers, and all parts of body away from openings and moving parts.

  11. Use with extra care when cleaning on stairs.

  12. DO NOT vacuum flammable or combustible materials or anything that is burning or smoking, such as cigarettes, matches, or hot ashes.

  13. Sparks inside the motor can ignite flammable vapors or dust. To reduce the risk of fire or explosion, DO NOT use near combustible liquids, gases, or dusts, such as gasoline or other fuels, lighter fluid, cleaners, oil-based paints, or natural gas.

  14. To reduce the risk of inhaling toxic vapors or dust, DO NOT vacuum or use near toxic or hazardous materials.

  15. Empty the Intercept Micro® Filter after every use and before storage. Some types of wood dust and debris may catch on fire, if stored in the vacuum.

  16. DO NOT use without filters in place.

  17. Disconnect battery pack before servicing vacuum.

  18. Ensure the vacuum has been turned off before disconnecting the battery pack.

  19. Disconnect the battery pack from the vacuum before making any adjustments, changing accessories, or storing appliance. Such preventive safety measures reduce the risk of starting the vacuum accidentally

To reduce the risk of damage to the battery’s electrical connectors, the lock must be fully engaged when battery is attached to vacuum.

When using an electrical appliance, basic precautions should always be followed, including the following.

Battery Pack and Charger Safety:

Read all safety warnings and instructions in the manual and on the battery pack, charger, and vacuum before using this vacuum. Failure to follow the warnings and instructions may result in electric shock, fire, property damage and/or serious injury or death.

  1. Use only ProTeam charger 107685 and ProTeam battery packs 107683 and 107684. See website for additional battery pack and charger compatibilities. A charger that is suitable for one type of battery pack may create a risk of fire when used with another battery pack. Use of any other battery packs may create a risk of injury and fire.
  2. DO NOT use charger to charge non-rechargeable battery packs.
  3. Hazardous Voltage: Risk of electrocution (high voltage), explosion, fire and burns. DO NOT open, crush, or electrically short terminals.
  4. When charging, make sure that the charger has at least 6 inches of clearance on all sides. Adequate airflow is required to cool the charger when in use.
  5. DO NOT expose charger and battery packs to rain or other liquids, keep dry. Install charger in a safe indoor location. Indoor use only.
  6. Connect charging cord to a properly grounded outlet only. See Grounding Instructions.
  7. DO NOT leave charger plugged in when not in use.
  8. DO NOT operate charger if it has received a sharp blow, been dropped, or damaged in any way.
  9. DO NOT use charger if it has a damaged cord or plug. Replace cord immediately.
  10. DO NOT carry charger by cord.
  11. DO NOT pull on charger’s cord to unplug. Grasp and pull the plug, not the cord.
  12. DO NOT handle charger, including charger plug and charger terminals, with wet hands while charger is plugged in or while inserting plug into electrical outlet.
  13. DO NOT use or store vacuum or battery packs in wet or moist conditions, or near flammable or combustible materials.
  14. When battery pack is not in use, keep it away from other metal objects, like paper clips, coins, keys, nails, screws, or other small metal objects that can make a connection from one terminal to another. Shorting the battery pack or charger terminals together may cause burns or a fire.
  15. DO NOT use vacuum and battery pack in temperatures above 104°F (40°C) or below 50°F (10°C). DO NOT charge the battery pack in temperatures above 104°F (40°C) or below 50°F (10°C). Follow all charging instructions. Charging at temperatures outside of the specified range may damage the battery pack and increase the risk of fire. DO NOT store battery pack in ambient temperatures above 140°F (60°C) or below 50°F (10°C).
  16. DO NOT expose battery packs to temperatures above 140°F (60°C). Never leave battery packs in automobiles on hot days, where temperatures can be much higher than the outside temperature.
  17. DO NOT store vacuum or battery pack for extended periods (1 month or more) in temperatures above 90°F (32°C) or below 50°F (10°C).
  18. DO NOT use a battery pack or vacuum that is damaged or modified. DO NOT crush, drop, incinerate, or damage the battery pack. DO NOT incinerate the battery pack even if it is non-working or severely damaged. The battery pack can explode in a fire. Damaged or modified batteries may exhibit unpredictable behavior resulting in fire, explosion, or risk of injury.
  19. DO NOT attempt to repair, service, or modify the battery pack or charger. Contact ProTeam Customer Service with any issues.
  20. Battery pack and charger are non-serviceable and must be replaced if damaged.
  21. Under abusive conditions, liquid may be ejected from the battery pack; avoid contact. If contact accidentally occurs, flush with water. If liquid contacts eyes, additionally seek medical help. Liquid ejected from the battery pack may cause irritation or burns.
  22. DO NOT Incinerate or expose a battery pack or appliance to fire or excessive temperature. Exposure to fire or temperature above 265°F (130°C) may cause explosion. Keep sparks and flames away from the battery pack.
  23. Turn “OFF” the vacuum power switch and then remove the battery pack before performing maintenance or servicing the vacuum. Unexpected actuation of the power switch while clearing jammed material, making adjustments, storing, changing accessories, performing maintenance or servicing the vacuum may result in serious personal injury.

INTRODUCTION

MOTOR

Electric thru-flow vacuum motors must never be used in applications in which wet or moist conditions are involved, where dry chemicals or other volatile materials are present, or where airflow may be restricted or blocked. Such motors are designed to permit the vacuumed air to pass over the electrical wiring to cool it. Therefore, any liquid (including water), dry chemical, or other foreign substance which would come in contact with electrical conductors could cause combustion (depending on volatility) or electrical shock. Failure to observe these precautions could result in property damage and personal injury, including death in extreme cases.

ELECTRICAL

The GoFit is supplied with the battery pack and charger. The nominal operational voltage of the backpack vacuum is 54 Volts DC. The charger is designed for a nominal input of 3.7 amps at 120 Volts AC, and an output of 5.8 amps. Other backpack models are available in 120 Volts AC configurations. Model numbers and specifications can be obtained by calling ProTeam.
The vacuum cleaner described in this manual is equipped with a thermal protection cutoff device. This integrated thermal cutoff switch will remove power from the vacuum motor in the event excessively high operating temperatures are detected. This condition may arise as the result of a blocked vacuum passage, or clogged or full filters. Should a thermal trip take place, immediately turn off the vacuum, remove the battery pack, and inspect for a blockage and verify the condition of the filter bag.
Replace or empty the filter bag as required. The vacuum will require several minutes to cool down to a safe operating temperature. When this temperature is attained, the thermal switch will reset and the vacuum will be able to be used in a normal manner.

BATTERY PACK REMOVAL AND PREPARATION FOR RECYCLING

Dispose of old battery pack in an environmentally safe way according to your local regulations. Contact your local regulatory authorities for proper transporting and disposal instructions. It is illegal in most jurisdictions to dispose of Lithium ion batteries in ordinary trash.

For 4Ah (107683) and 8Ah (107684) Battery Packs: Contact your local waste authority for information regarding available recycling and/or disposal options. Or contact ProTeam customer service at 866.888.2168 or customerservice.proteam@emerson.com for the latest information. In some jurisdictions Call2Recyle will accept the 4Ah and 8Ah battery packs. Recycling your old batteries is easy with the Call2Recycle program.

Upon removal, cover the battery pack’s terminals with heavy duty adhesive tape. DO NOT attempt to destroy or disassemble battery pack or remove any of its components. Lithium Ion battery packs must be recycled or disposed of properly. Never touch battery pack terminals with metal objects, as a short circuit may result. Keep away from children. Failure to comply with these warnings could result in fire and/or serious injury.

Observe the following warning that appears on the battery charger:
Double insulated – Grounding not required. When servicing use only identical replacement parts.
To reduce the risk of electric shock, this Charger has a Polarized Plug (one blade is wider than the other). This Plug will fit in a Polarized Outlet only one way. If the Plug does not fit fully in the Outlet, reverse the Plug. If it still does not fit, contact a qualified electrician to install the proper Outlet. Do not change the Plug in any way.

SERVICING OF DOUBLE INSULATED BATTERY CHARGER

In a double-insulated battery charger, two systems of insulation are provided instead of grounding. No grounding means is provided on a double-insulated appliance, nor should a means for grounding be added. Servicing a double- insulated battery charger requires extreme care and knowledge of the system, and should be done only by qualified service personnel. Replacement parts of a double-insulated battery charger must be identical to the parts they replace. Your double-insulated battery charger is marked with the words “DOUBLE INSULATED” and the symbol (square with a square) may also be marked on the appliance. To reduce the risk of injury from electrical shock, unplug power cord before servicing the electrical parts of the battery charger.

PREPARING BATTERY PACK FOR CHARGING

  1. Plug the charger’s power cord into the charger (Figure A).

  2. Plug the charger’s power cord into 120V wall outlet (Figure B).

  3. Install battery on charger as shown (Figure C).

Preparing Battery Pack For Charging

  1. The Charger indicator light will turn on solid red (standby) after inserting the battery. When charge cycle begins the indicator will change from solid red to flashing green. When Charger indicator light changes from flashing green to solid green, battery is 100% charged. The battery pack will require approximately 50 minutes (4Ah) or 90 minutes (8Ah) to fully charge.

  2. If the indicator light flashes red, remove the battery and then reinstall it. If it still flashes red, contact ProTeam Customer Service for further instructions.

  3. If the Charger indicator light flashes amber, there is a temperature-related error. Please let the battery rest at room temperature for at least 1 hour. The Charger indicator light should turn flashing green, fan should turn on, and battery pack will begin charging once the battery temperature settles within the acceptable charging temperature range.

QUICK START

  1. Unlatch the single clamp on the top of the unit and pivot the cap to the vertical position (Figure A).

  3. Check to make sure the HEPA Media Dome Filter did not shift during shipping (Figure C).

  4. Replace the Intercept Micro Filter and the Micro Cloth Filter into the vacuum (Figure B).

  5. Pivot the cap back to the horizontal position and relatch the single clamp (Figure A).
    DO NOT use without filters in place or with damaged filters.

  6. Push the hose into the cap opening (Figure D).

HARNESS HEIGHT ADJUSTMENT

  1. Upper harness should sit between shoulder blades for most comfortable fit. The upper harness can be adjusted by sliding the upper harness along the Quick Adjust track (See side view of vacuum and harness Figure E). DO NOT adjust harness height while wearing the backpack.

  2. To move the upper harness, pull on the purple tab located between the upper harness pad and the vacuum (Figure F) to release the locking feature. Maintain pressure on this pull tab and slide the upper harness (Figure G), identified with a purple “1”, to the desired location before releasing the tab.

  3. Ensure the upper pad is locked by gently pulling on the carry handle to make sure there is no further movement.

BACKPACK ERGONOMICS

  • The weight of the vacuum should be evenly distributed on your hips.
  • Adjust the padded waist belt and shoulder straps using the numbered adjustment straps for a custom fit.
  • The areas on the harness that touch the user are made from breathable mesh material to keep the operator cool.
  • The on/off switch is conveniently located on the waist belt of the backpack vacuum. The switch box is secured to the waist belt with Velcro® straps running through the top and bottom of switch box and securing to each other.
  • Use the proper attachments for the job. ProTeam has attachments to perform most jobs without requiring you to bend over or getting into difficult positions.
  • The padded articulating harness design provides increased range of motion during detail and overhead work reducing operator fatigue and increasing productivity.

INTERCHANGEABLE HARNESS PADS

  1. The upper harness padding and lower harness padding are attached to the backpack through Velcro straps located on the rear of the harness pad.

  2. To switch the harness, pull the upper half of the harness cover up and away from the plastic inside.

  3. Slide the cover downwards to remove from the plastic pieces (Figure I).

  4. Perform the steps in reverse to place your personal harness on the vacuum, ensuring that the Velcro is properly secured by pressing on the purple fabric pockets.

WEARING THE BACKPACK VACUUM

  1. Loosen the shoulder straps and the waist belt. Lift the vacuum and slide your arms through the straps (Figure J).

  2. Connect the waist strap (Figure K).

  3. Tighten the waist belt by grabbing the ends of the straps, identified with a purple “2”, and pulling each end toward each other and then directly outward from the center of the body. It is very important that the weight of the unit be concentrated on your hips rather than your shoulders (Figure L).

  4. Adjust the shoulder straps, identified with a purple “3”, so that the upper harness pad touches your back between your shoulders. Unit should fit comfortably with the weight still concentrated on your hips (Figure M).

  5. Connect the sternum strap buckle, identified with a purple “4” (Figure N), and slide the strap up or down on the sewn-in wire support for the best fit (Figure O).

TROUBLESHOOTING

  1. If the vacuum will not operate, check the following:
    a. The battery pack connection to the vacuum.
    b. The battery pack is charged.

  2. If the battery pack is not charging, check that the charger is plugged into an electrical outlet and that the battery pack is properly connected to the charger.
    Note : The battery pack may be in Temperature Error mode for approximately an hour before charging to allow the battery temperature to settle within the acceptable charging temperature range.

  3. If the exhaust air from the bottom of the vacuum is warmer than usual, check, clean or replace all filters.

  4. If loss of suction occurs, check the following:
    a. Check that debris is not plugging the hose, wand, and/or floor tool.
    b. Check, clean or replace the filters (Intercept Micro Filter, Micro Cloth Filter, and HEPA Media Dome Filter).
    c. Check that the hose cuffs are fitting tightly on the hose and are not cracked.
    d. Check that the cap is properly attached to the vacuum body.

  5. If the charger’s LED indicator is off after the battery pack is inserted, check both ends of the power cord.

FILTER MAINTENANCE

Note : When opening the cap to check/change filters, ensure the upper harness is not locked in the highest position on vacuum body. Please refer to page 6 under Harness Height Adjustment for detailed steps.

  1. Empty and inspect the Intercept Micro Filter every time you start and finish vacuuming (Figure A).

Replace if necessary. A clogged and dirty filter restricts airflow and results in reduced suction and overheating.

  1. To replace the Intercept Micro Filter, slide filter into the Cloth Filter and secure into vacuum (Figure B).

  2. Once a month, or as necessary, hand or machine wash the Cloth Filter and let it air dry. DO NOT put it in the dryer (Figure C).

To reduce the risk of fire, electric shock or injury, do not use the vacuum with a wet cloth filter bag or dome filter.
Allow the filters to dry completely before reinstalling.

  1. Every two to three weeks, or as necessary, clean the HEPA Media Dome Filter.
    a. First, remove the Intercept Micro Filter and Cloth Filter. Reach into the vacuum body and rotate the HEPA Media Dome Filter counter-clockwise until it comes off (Figure D).

b. Shake out the HEPA Media Dome Filter (Figure E).

c. Replace and rotate the HEPA Media Dome Filter clockwise into place.

  1. DO NOT use without filters in place or with damaged filters.

Note : If the HEPA Media Dome Filter becomes discolored, replace it with a new HEPA Media Dome Filter. The life of the filter will depend greatly on the use and care of the Intercept Micro Filter and Cloth Filter.

RECOMMENDED PREVENTIVE MAINTENANCE

  • CHECK the condition of all electrical cords before each use.
  • Remove the battery from the vacuum when performing any maintenance.

UPON RECEIPT

Check unit for any defects, missing or broken parts. Call ProTeam with this information, along with any questions you may have.

DAILY/BEFORE EACH USE

Check Intercept Micro Filter. Replace or empty if full. Use only genuine ProTeam replacement filters to ensure optimal performance, achieve improved indoor air quality, and to maintain a valid vacuum warranty.
Check Micro Cloth Filter. If dirty, rinse out and air dry before replacing back into vacuum. All filters must be in place to operate vacuum. This will optimize airflow and prevent the motor from laboring.

PERIODICALLY

Check harness for fit and comfort. Replace lost or damaged pieces.

ELECTRICAL CORD CARE

NEVER stretch the cord tightly between the charger and the outlet. A cord that is stretched or pulled may not function properly, can damage the cord or plug, and creates a tripping hazard. Immediately stop using a damaged cord and replace with a new cord. Contact ProTeam customer service at 866.888.2168 or customerservice.proteam@emerson.com for a new replacement cord.
If the connectors on the charger are damaged, the charger should be replaced. Contact ProTeam, or an authorized ProTeam distributor, for instructions on ordering replacement components.

PROPER STORAGE

When the vacuum is not in use, the vacuum, charger, battery pack, and accessories should be stored indoors and in a dry place. Take appropriate safety measures by reading the IMPORTANT SAFETY INSTRUCTIONS in this Owner’s Manual.

LIMITED WARRANTY

This limited warranty applies to all ProTeam®, Inc. products, including, without limitation, Backpacks, Uprights, Air Movers, and Wet/Dry product lines, and certain battery packs and chargers (collectively, the “products”). Specific warranty terms for certain product parts, motors, battery packs and accessories are stated below.

Limited Warranty

ProTeam, Inc., located at 8100 W. Florissant Ave, Building T, St.
Louis, MO 63136 (“ProTeam” or “we”) warrants to the original purchaser only (“you” or “your”), subject to “Warranty Exclusions” (as applicable), that the product parts, motor, battery packs and/ or charger identified below will be free from defects in materials and workmanship, including labor costs in connection therewith, when under normal use and service beginning on the original date of purchase and continuing for the corresponding period (each a “Warranty Period”). This limited warranty terminates if you transfer the product to any other person or entity.

Molded Body Parts

  • All molded body parts, except as indicated below – expected lifetime of the product

Motors

  • Backpack (other than specified below), Upright products – 3 years or 1600 hours, whichever comes first, subject to your compliance with the following carbon brush replacement and maintenance schedule. Proof of such compliance may be required:

    • 3rd change – after the next 200 hours of operation
  • GoFit® 3, GoFit 6, GoFit 6 PLUS, GoFit 10, GoFit HEPA, Super Coach Pro® 6, Super Coach Pro 10 and ProVac® FS 6 – 3 years or 1900 hours, whichever comes first, subject to your compliance with the following carbon brush replacement and maintenance schedule. Proof of such compliance may be required:
    • 1st change – after the first 1000 hours of operation

What is Not Covered – Warranty Exclusions
This limited warranty does not extend to and expressly excludes:

  • Normal wear and tear on the product and/or attachments and accessories including, without limitation, extension cords and cord holders; hoses; filters; switches; motor carbon brushes; wands and floor tools; detachable accessories; wheels; brush rollers and belts; bumpers/plates; straps and buckles; latches.
  • Damage or burnout of the product motor resulting from failure to clear a blockage occurring during the normal course of use.
  • Loss or damage to the product resulting from conditions beyond ProTeam’s control including without limitation, misuse, accident, abuse, neglect, negligence (other than ProTeam’s), use beyond listed capacity, or improper installation, maintenance or application.
  • Improper modification or alteration may nullify this limited warranty.
  • Loss or damage to the product resulting from failure to follow the required maintenance schedule, or failure to use the product in accordance with ProTeam’s written instructions, guidelines or the terms of its Owner’s Manual.
  • Lithium Ion Battery Charger limited warranty applies only to defects arising under normal usage. All other damages are expressly excluded.

How to Notify ProTeam

If you discover that your product has a defect that you believe is covered by this limited warranty, you must notify ProTeam or the ProTeam authorized dealer who sold you the product within the applicable Warranty Period. You may contact ProTeam Customer Service department at 866-888-2168 via the fax number or the email address listed in your Owner’s Manual or at proteam.emerson.
com. Customer service hours may vary and will be updated on the ProTeam website. In order for a warranty claim to be processed as quickly as possible, we suggest that you complete the registration card made available to you on the ProTeam website at proteam.
emerson.com. If you do not complete a registration card, you will be required to present a dated sales receipt in order to receive warranty service. Warranty coverage for all products is subject to your compliance with the listed notification and repair procedures. Notification procedures for the GoFree Flex Pro II and GoFit battery packs are set forth below.

What We Will Do to Correct Problems

ProTeam or your local ProTeam authorized dealer will determine whether your claim is covered by this limited warranty, subject to the limitations or exclusions described above, and whether the claim is within the applicable Warranty Period. For all warranty claims other than for the GoFree Flex Pro II and GoFit battery packs, provided your claim is covered under this limited warranty, ProTeam or its authorized dealer will, at ProTeam’s sole option and discretion, (a) repair or replace the defective portion of your product or (b) replace your entire product. GoFree Flex Pro II and GoFit battery packs are not field serviceable. If ProTeam is unable to repair your product or provide you with a suitable replacement, you will receive a refund of your purchase price or a credit to be used toward the purchase of a new product or GoFree Flex Pro II and GoFit battery packs. Products repaired or replaced during the Warranty Period shall be covered for the remainder of the original Warranty Period. Unauthorized repairs or modifications, or use of any parts other than genuine ProTeam parts, will nullify this limited warranty.

GoFree Flex Pro II and GoFit Battery Packs Notification Procedures

The GoFree Flex Pro II and GoFit battery packs are not field serviceable. Contact ProTeam Customer Service at 866.888.2168 for service options. Please call the Customer Service department number above or visit the ProTeam website to request a RAN. If you have not submitted a completed registration card, you must include a dated, written proof-of-purchase and a statement explaining the nature of the malfunction with the RAN. If there is no local ProTeam authorized dealer, ProTeam’s Customer Service will give you the name and address of the nearest field service representative.

No Other Express Warranty Applies

THE LIMITED WARRANTIES PROVIDED ABOVE ARE THE SOLE AND EXCLUSIVE WARRANTIES PROVIDED BY PROTEAM TO YOU, AND ARE IN LIEU OF ALL OTHER WARRANTIES, WRITTEN OR ORAL, EXPRESS OR IMPLIED, WHETHER ARISING BY OPERATION OF LAW OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WHETHER OR NOT THE PURPOSE HAS BEEN DISCLOSED AND WHETHER OR NOT THE PRODUCT HAS BEEN SPECIFICALLY DESIGNED OR MANUFACTURED FOR YOUR USE OR PURPOSE. THE FOLLOWING SENTENCE APPLIES ONLY TO CONSUMER PURCHASERS: DISCLAIMERS OF IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, SHALL NOT TAKE EFFECT UNTIL THE END OF THE WARRANTY PERIOD. No employee, agent, dealer, or other person is authorized to alter this limited warranty or make any other warranty on behalf of ProTeam. The terms of this limited warranty shall not be modified by ProTeam, the original owner, or their respective successors or assigns.

Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PROTEAM BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING ANY ECONOMIC LOSS, WHETHER RESULTING FROM NONPERFORMANCE, USE, MISUSE OR INABILITY TO USE THE PRODUCT OR PROTEAM’S NEGLIGENCE. PROTEAM SHALL NOT BE LIABLE FOR DAMAGES CAUSED BY DELAY IN PERFORMANCE AND IN NO EVENT, REGARDLESS OF THE FORM OF THE CLAIM OR CAUSE OF ACTION (WHETHER BASED IN CONTRACT, INFRINGEMENT, NEGLIGENCE, STRICT LIABILITY, OTHER TORT OR OTHERWISE), SHALL PROTEAM’S LIABILITY TO YOU AND/OR YOUR CUSTOMERS EXCEED THE PURCHASE PRICE PAID BY YOU FOR THE PRODUCT. The term “consequential damages” shall include, but not be limited to, loss of anticipated profits, business interruption, loss of use or revenue, cost of capital or loss or damage to property. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
This limited warranty is governed by the laws of the State of Missouri, U.S.A., without regard to conflicts of law provisions.

Dispute Resolution

In the event of any dispute INCLUDING, BUT NOT LIMITED TO, BREACH OF CONTRACT, BREACH OF WARRANTY, CLAIMS BASED IN TORT, NEGLIGENCE, PRODUCT LIABILITY, FRAUD, MARKETING, STATE OR FEDERAL REGULATIONS, ANY CLAIMS REGARDING THE ENFORCEABILITY OF THIS LIMITED WARRANTY, AND THE WAIVER OF CLASS ACTION TRIALS between PROTEAM AND YOU, either party may choose to resolve the dispute by binding arbitration, as described below, instead of in court. THIS MEANS IF EITHER PROTEAM OR YOU CHOOSE BINDING ARBITRATION, NEITHER PARTY SHALL HAVE THE RIGHT TO LITIGATE SUCH CLAIM IN COURT OR HAVE A JURY TRIAL. DISCOVERY AND APPEAL RIGHTS ARE LIMITED IN BINDING ARBITRATION. ProTeam and You agree that the proper venue if Arbitration is not so chosen by ProTeam OR You of all actions arising in connection herewith shall be only in the state of Missouri and the parties agree to such jurisdiction.
No action, regardless of form, arising out of transactions relating to the agreement, may be brought by either party more than two (2) years after the cause of action has accrued. The U.N. Convention on Contracts for the International Sales of Goods shall not apply to this agreement.

Class Action Waiver

BINDING ARBITRATION MUST BE ON AN INDIVIDUAL BASIS.
THIS MEANS NEITHER PROTEAM OR YOU MAY JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION BY OR AGAINST OTHERS, OR LITIGATE IN COURT OR ARBITRATE ANY CLAIMS AS A REPRESENTATIVE OR MEMBER OF A CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY

Administration of Arbitration

The binding arbitration must be administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules and/or Supplementary Procedures for Consumer Related Disputes (including proceedings to mitigate costs of travel).
This binding arbitration is governed by the Federal Arbitration Act (“FAA”) (9 USC §1, et. seq.) and will govern the interpretation and enforcement. The binding arbitration shall be held at a location determined by AAA or at such other location as mutually agreed.
In addition to the terms stated above, the following will apply to the binding arbitration: (1) the arbitrator, and not any federal, state, or local court or agency, will have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability or formation of this agreement including any claim that all or any part of this agreement is void or voidable; (2) the arbitrator shall apply Missouri law consistent with the FAA.
