WARRANTY

1 YEAR LIMITED MEMBRANE WARRANTY

  1. Subject to the conditions set out in this warranty, during the Warranty Period and provided the Material was installed according to the installation guidelines, Skyline Building Systems Inc. (Manufacturer) warrants to the original purchaser (Purchaser) as follows:
  2. The Material shall be free from manufacturing defects;
  3. The Material shall not wear through under normal usage conditions
  4. The Material shall remain adhered to recommended substrates (as described in the installation guide).
  5. Warranty Period: One (1) year from date of purchase for the Dec-Tec DIY membrane (Material).
  6. Limit of liability: Manufacturer extends only this limited warranty. Buyer specifically waives all other warranties, (whether express or implied, oral, or statutory, and including any implied warranties of merchantability or of fitness for a particular purpose), applicable to the goods or to the seller. Liability is limited to price paid for defective portion of product excluding labor costs and other expenses not provided directly from Manufacturer. The Purchaser is responsible for the workmanship with respect to the installation of the Material. This warranty is non-transferrable. The Purchaser is responsible for understanding any and all local building codes that are relevant and or apply to the appropriateness and use of the Material.
  7. If there is an issue with respect to 1a, 1b, or 1c above, then Manufacturer will, at its option:
  8.  Reserve the right to request samples of any Material in a claim situation.
  9. Reserve the right of inspection of the installed surface either by a representative of the Manufacturer or a third-party inspection firm.
  10. Provide membrane to replace or repair such defect or worn-out area, or
  11. Refund to the owner the original purchase price of the Material. If the original purchase price of the Membrane cannot be determined then Manufacturer, at its sole discretion, will establish a fair value to be used in lieu of the original purchase price not to exceed the ‘list’ price at the date of sale.
  12. This warranty excludes:
  13. Damage to the Material membrane caused by: Acts of God; fortuitous events; settlement distortion; failure, cracking or movement of deck, wall, or foundation of the building; work performed on or to the deck after installation; use of incompatible adhesives, patching compounds or accessories together with the Material; ponding of water or improper drainage; impact of foreign objects; contamination of the membrane by corrosive chemicals, oils and greases; or any misuse, neglect or improper storage or handling of the Material.
  14. Dissatisfaction due to improper installation or maintenance.
  15. Deviance from the recommended Care & Maintenance guide resulting in damage.
  16. Problems arising as a result of the installation of the Material, including but not limited to improper preparation of the surface upon which the Material is installed or the structure of such surface or the materials used in construction of such surface.
  17. Damage to the exterior or interior of the deck or building upon which the Material is installed or to property contained therein.
  18. Any injuries sustained by any person or any economic losses or consequential damages of any kind.
  19. Color variations from samples or printed illustrations compared to actual production runs, fading and reduction of gloss due to weathering and use.
  20. Problems due to moisture, including discoloration, alkali, condensation, hydrostatic pressure, fungus, mold, bacteria, spores, mycotoxins, or the like.
  21. Accidental damage due to causes including but not limited to: narrow tipped heels, burns, cigarette burns, cuts, scratches, gouges, and indentations, including damage from improper floor protectors and furniture rests.
  22. Installation costs required to replace or repair damage caused by a faulty installation.
  23. Manufacturer and Purchaser agree to attorn to the jurisdiction and courts of the Province of Alberta, Canada, for any disputes that may arise relating to the herein warranty.
  24. No representative, employee, or agent of Manufacturer, or any other person, is authorized to assume any additional liability or responsibility in connection with Material except as described above.
  25. All claims under this limited warranty must be made in writing to the Manufacturer, to [email protected] within thirty (30) days of discovery of the alleged defect, wear through or improper adhesion, otherwise, the warranty will be considered null and void. All claims must include a copy of the invoice or contract establishing the date of purchase and the original cost of the Material. Manufacturers must be allowed a reasonable opportunity to inspect any alleged warrantable issue before any repairs or replacements are made. Any defective Material may, at the Manufacturer’s option, become Manufacturer’s property or be disposed of by the owner. Whenever possible, Manufacturer will replace defective Material with Material of similar design and/or color. Manufacturer will not be responsible for differences in color or dye lots between replacement Material and the original Material.

Note : Some states prohibit limitation on the duration of implied warranties, as well as the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. This warranty gives you specific legal rights, which may vary from state to state.
