Legislative Update
On May 29th, 2024, Florida Governor Ron DeSantis signed legislation into law
making important changes to HVAC manufacturer warranties.
The legislation prohibits the conditioning of a manufacturer’s warranty on
product registration if the HVAC equipment is installed by a contractor
licensed by the Florida Department of Business and Professional Regulation.
The law requires warranty conveyance / transferability upon sale of the home,
regardless of product registration, but does not extend any existing product
warranty terms.
Additionally, manufacturers will be required to include in product
registration materials an explicit statement that failure to register a
product does not diminish any warranty rights nor decrease the warranty
length.
The law is effective on real property conveyances on or after July 1, 2024.
Customer Communication Objectives
Effective July 1, 2024, a manufacturer’s warranty may not be in any way
conditioned upon the product registration.
Registration of HVAC equipment under the terms of the Limited Parts Warranty
will no longer be required in Florida.
Florida residential applications, regardless of homeowner, installed before
July 1, 2024, will continue to receive the original installed warranty
coverage. Products installed on/or after July 1, 2024, will receive warranty
coverage based on the longest coverage offered on each model’s Limited Parts
Warranty.
Frequently Asked Questions
1. Q: For products installed prior to July 1, 2024, what is the warranty?
A: If the warranty was 5 years prior to July 1, 2024, the warranty remains at 5 years. Those with 10-year warranty remain at 10 years. In both situations, these warranties apply to the property for the length of the warranty coverage and are not related to the homeowner.
2. Q: For products installed on or after July 1, 2024, what is the warranty ?
A: The warranty coverage for these installations will be tied to the property and the warranty coverage will be based on the longest coverage offered on each model’s Limited Parts Warranty.
3. Q: After July 1, 2024, can products installed in Florida be registered?
A: No. The law eliminates the need for registration to receive additional warranty coverage, so there will be no benefit to registration. B: Considering Rheem’s current 90-Day Registration period, units that might have been registered and/or units eligible for registration from 4/1/2024-6/30/2024, will be grandfathered into the new policy that gets enacted on 7/1/2024.
4. Q: How does this affect the warranties for Rheem® Select , Ruud® Choice and Weatherking®?
A: As of July 1, 2024, warranty registrations will not be required for Florida installations. Warranties for these products will follow the terms of the limited parts warranty document provided with the product. Paid registrations will no longer exist.
