LIMITED WARRANTY
INNOVAIR GOLDTEC CENTRAL HEAT PUMP LINE This limited warranty applies to the
following model numbers:
Outdoor Units: VEA24H2V18 / VEA36H2V18 / VEA48H2V18 / VEA60H2V18 / DHV24H2V18
/ DHV36H2V18 / DHV48H2V18 / DHV60H2V18
This heating or air conditioning unit is warranted by Innovair Corporation to
be free from defects in materials and workmanship under normal use and
maintenance as described below:
All Warranty begins on the date of installation. If date of installation
cannot be verified then warranty begins 60 days aft er the date of
manufacture.
This warranty agreement supersedes all prior warranty agreements between the
parties and constitutes the complete, final and exclusive understanding of the
parties with respect to the subject matter. All prior negotiations,
representations, or promises, whether oral or written, of either party shall
be deemed to have been merged herein.
Residential Warranties applies to: Innovair warrants that all compressors and
internal components incorporated into the Product at the time of shipment
shall remain free from defects in workmanship and materials for ten (10) years
limited parts and ten (10) years compressor from the Commencement Date as
defined below:
· For Products installed in newly constructed homes: date of home purchase by
homeowner from builder.
· For Products installed in existing residences: original date of
installation.
· If the above two cases cannot be verified: 60 days from the date of
manufacture (as designated by the serial number on the unit).
This limited warranty applies only to Residential Application if:
- The unit is properly registered with Innovair within 60 days after the
original installation*. 2) The product is installed in an owner-occupied,
single family residence. Rental properties are not considered Residential
application. Please
refer to Commercial Application below 3) The product remains in the original installation location. 4) The product is installed by contractors who are licensed HVAC professionals and in compliance with all local, state and provincial laws. 5) The product is installed, maintained and used in accordance with the manufacturer’s recommendations as outlined in the Installation and Use
& Care manuals. 6) Defective parts must be returned to the distributor for credit.
Commercial Application Commercial warranty applies only to units installed in buildings other than residences and in residences that are not owner-occupied. Innovair warrants that all compressors and internal components incorporated into the Product at the time of shipment shall remain free from defects in workmanship and materials for five (5) years limited parts and five (5) years compressor from the Commencement Date as defined below: - The unit is properly registered with Innovair within 60 days after the
original installation*. 2) The product is installed with a voltage or surge
protector, UL or ETL or CSA rated 3) The product remains in the original
installation location. 4) The product is installed by contractors who are
licensed HVAC professionals and in compliance with all local, state and
provincial laws. 5) The product is installed, maintained and used in
accordance with the manufacturer’s recommendations as outlined in the
Installation and Use
& Care manuals. 6) Defective parts must be returned to the distributor for credit.
*If a product is installed in a newly constructed home, the installation date is assumed to be the date of purchase. If that date cannot be verified, the warranty period begins 90 days from the date of manufacture.

This Limited Warranty Statement applies only to systems that are properly
installed by a state certified or licensed HVAC contractor, under applicable
local and state law in accordance with all applicable building codes and
permits; and operation instructions and good trade practices.

- Are installed outside the United States of America 2) Are operated in
unoccupied structures or used for purposes other than comfort cooling /
heating. 3) Has been removed from the place it was originally installed and
reinstalled at another place. 4) Have been claimed as damage and credited.
Limitation ofWarranties: ALLIMPLIED WARRANTIES INCLUDING BUT NOTLIMITED TOWARRANTIES OFMERCHANTABILITYAND FITNESS FORAPARTICULAR USEORPURPOSE,ARE LIMITED TOTHEDURATION OFTHISLIMITED WARRANTY.
Some states and provinces do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. The express warranties made in the limited warranty document are exclusive and may not be altered by any dealer, distributor or other persons whatsoever.
FORANY INCIDENTAL ORCONSEQUENTIAL PROPERTY DAMAGE, INNOVAIR SHALL NOT BE HELD LIABLE. For residents of states and provinces that do not allow the exclusion or limitation of incidental or consequential damages, the above exclusion may not apply to you.
This warranty does not cover
1. Failure or malfunction resulting from improper or negligent operation, accident, abuse, freezing, electrical imbalance characteristics, misuse, unauthorized alteration, incorrect electrical supply, electrical surges, or improper installation, repair or maintenance. See the Installation Instructions for installation, operation and maintenance information.
2. Use of components or accessories that are not compatible with this unit.
- Damage or repairs resulting from faulty installation, application,
maintenance, abuse or unauthorized alteration of the product. 4. Failure or
malfunction resulting from any conditions within the structure, including mold
and/or mildew and/or any chemical or toxin
secreted there from or damage resulting from mold, fungus or bacteria. 5. Products installed outside the United States or Canada. 6. Parts not supplied by Innovair or damage resulting from the use of parts not supplied or designated by Innovair. 7. Failure or malfunction resulting from a contaminated or corrosive liquid supply, the addition of unapproved chemicals, operation at
abnormal temperatures, pressures or fl ow rates, opening of the refrigerant circuit by unqualified personnel or any attachment, accessory or component not authorized and approved by Innovair. See the Installation Instructions for installation, operation and maintenance information. 8. Changes in the appearance of the unit that do or do not affect its performance. 9. Products not installed in accordance with federal efficiency standards as issued by the Department of Energy. 10. Failure or malfunction due to misapplication or faulty building design or construction, including inadequate refrigerant levels, condensate drain, refrigerant line design or installation. 11. The cost of labor, shipping, or material charges or damages that may result from transportation, installation, or servicing. 12. Any cost related to the replacement, refilling or disposal of the refrigerant. 13. Products on which payment to Innovair is or has been in default. 14. Increase in fuel or electric cost 15. Damages or defects that are caused by events typically classified as “Acts of God.” These events are beyond the Company’s control and can include, but are not limited to: Earthquakes, Floods, Hurricanes, Tornadoes, Lightning Strikes, Fires (not caused by manufacturing defects), Volcanic Eruptions, Tsunamis, Avalanches, and other natural disasters or catastrophic events.
No person or entity is authorized to change the terms and conditions outlined in this Warranty agreement, in any respect, nor to create any additional obligations or liabilities for any party involved.

Pursuing legal remedies ARBITRATION CLAUSE. IMPORTANT. PLEASE REVIEW THIS
ARBITRATION CLAUSE, AS IT AFFECTS YOUR LEGAL RIGHTS. This arbitration clause
affects your rights against Innovair Solutions USA, Inc and any of its
employees, agents, affiliates, successors, or assigns, all of whom together
are referred to below as “we” or “us” for the simplicity of reference.
ARBITRATION REQUIREMENT: EXCEPT AS STATED BELOW, ANY DISPUTE BETWEEN YOU AND
ANY OF US SHALL BE DECIDED BY NEUTRAL AND BINDING ARBITRATION, RATHER THAN ANY
COURT OR BY TRIAL BY JURY. ARBITRATION WILL BE HANDLED ONLY ON AN INDIVIDUAL
BASIS AND ALL PARTIES EXPRESSLY WAIVE; ANY RIGHTS TO PARTICIPATE AS A CLASS
REPRESENTATIVE OR CLASS MEMBER, ANY RIGHTS TO CLASS ARBIRATION OR ANY
CONSOLIDATION OF INDIVIDUAL ARBITRATIONS. THE ARBITRATOR WILL BE A MEMBER OF
THE AMERICAN ARBITRATION ORGANIZATION. The meaning of “Dispute” has the
broadest possible meaning allowable by law, including any controversy, claim
or other dispute, relating to or arising from the purchase of the Product, any
of the warranties upon the Product, or the condition of the Product, as well
as the determination of the application or the scope of the Arbitration Clause
itself. Rights to appeal and discovery are also limited in arbitration based
on the rules of the arbitration organizations. Governing Law: Effect and
procedures of arbitration will be governed by the Federal Arbitration Act (9
U.S.C. § et seq.) rather than any related state law. In case of any
substantive warranty, your claims and rights under such substantive warranty
will be governed by the applicable law of the state in which Product was
purchased. Location of the Arbitration: Unless otherwise provided under the
applicable law, arbitration hearing will be conducted in the judicial district
in Miami-Dade County, Florida. Costs of the Arbitration: Unless otherwise
provided under the applicable law, each party will be responsible for; its own
costs payable to the arbitration organization, and the costs of their
attorneys, experts or other fees. Survival and Enforceability of the
Arbitration Clause: This arbitration clause will survive the expiration or
termination of this warranty agreement, indefinitely.
