Please read carefully this Safety and Product Information Guide before setup or use of the SkyTrak+™ system. Failure to read and follow the Safety and Product Information Guide may cause serious injury or death.
The SkyTrak+ system specifications and functionality are constantly evolving, and we may update or change the SkyTrak+ systern in whole or in part, without notice to you. Such updates may be required for you to use new functionality, access new courses or features, or continue to access and use existing courses and features. The courses and features available for use on the SkyTrak+ system change from time to time, and not all courses or features previously offered will be available. ‘Some features require an annual subscription. The software in the SkyTrak+ system is licensed and not sold to you, and is subject to the Product Use and License Agreement set forth in this Safety and Product Information Guide (the “Guide”).

Important Health and Safety Information

Please read the following important health and safety information before using the SkyTrak+ system. Failure to read and follow this safety information may cause serious injury or property damage.
Laser Device

CAUTION: Making any adjustments or performing any procedures on the SkyTrak+ unit may resultin exposure to hazardous radiation or otherwise cause injury.

The Sky Trake+ emits visible and invisible laser radiation. Do not stare into the beam or view directly with opticalinstuments. Faiure to folow these instructions may resut in serious injury. including eye damage.

cause serious injury, including biindness.
Proper Setup and Use
Using the SkyTrak+ System involves swinging a golf club and hitting a golf ball When swinging the gof cub or hiting the goif bl make Sure you have ample space to do SO without harming others or damaging property, and when indoors, take addiional precaution to avoid hitting the celing or other structures.

• Follow the diagram below for the minimum setup position of the SkyTrak+ system. Aways use the SkyTrak+ system in a safe area, away from people, especialy small chidren, as well as away from pets and property.
• When hitting gof balls indoors, including your garage, always use a safety netand a hitting mat which have been specificall designed for gof.
• When hitting goif balls outdoors, use safety net specifically designed for golf when your bal fight area is restricted, lie in the backyard of a residence.
• Use of a SkyTrak+ protective case, avalable for separate purchase, s highly recommended and required for warranty purposes if the product defect or failure is related to ohysical damage to the SkyTrak+ product resulting from a club or ball strike.

CAUTION: Even when using a safety net, errantly hit bals, ke shank which dramatically deviates from the intended target ine, may miss the safety net, potentiall causing injury or ‘damage, 0 adequate precaution should be taken to avoid injuries or damage in the event a hit ball misses the safety net.
To reduce the likelihood of personal injury o property damage, follow these rules when setting up the SkyTrak+ system:

• Place your smartphone, tablet or computer and any playback device like you television, safely away from the hitting area to the side and behind the goif ball
• Allindividuais in the area of the Sky Trak+ Syster duing use, except the one person hiting golf bals, should remain a safe distance away from the hiting area to the side and behind the golf ball.
• Aways use 3 goff hitting mat indoors to reduce the risk of damage to cameting or ather flooring materials, and for optimal performance, it is recommended that a goif hitting mat aways be used, bothindoors and outdoors.

Before taking each swing while using the SkyTraks system, slways first make sure that:

• The path of the golf swing s free of all persons, pets and property.
• Care shouid be taken to avoid hitting the SkyTrak+ device, especiall with certain swings, ke over- the-top moves that resuitin a wide outside-in swing, and certain training drs, such as those starting ‘out swinging the ciub horizontaly and moving into a vertical swing path. Always protect the SkyTrak+ device from over Swings.
• The hitting area s secure from indiiduals, pets, and property, and be especiall cautious of individuais and pets approaching the hitting area from behind the goffer.
• Individuals, pets and property are sufficiently away from the hitting area to avoid injury or damage in the event the golfer loses grip of the golf club during a swing
• Individuats, pets and property are sufficiently away from the hitting area to avoid injury or damage in the event the golfer miss-hits the golf ball and the golf ball leaves the intended target ine and misses the safety net.

WARNING: Faiure to follow these setup and use precautions can lead to serious injury or death to persons and damage to property.
Use by Children and Inexperienced Users
The SkyTrak+ system is designed for adult use and for individuals with some prior golfing experience.

• Use of the SkyTrak+ system by children should only be done with adult supervision.
• Individuals without goifing experience should be aware of their surroundings and the amount of ‘space needed to swing and hit a goff ball, and shouid be aware that erantly hit golf bals, lie shank, can dramatically deviate from the infended target ine. It is recommended that those Wwithout goifing experience first use the Sky Trak+ System with someone with golfing experience.

Avoiding Water and Wet Locations
Exposure to water may cause damage to the SkyTrak+ System and electric shock to the user. Do not use the SkyTrak+ system in wet locations. Use extra caution when using the SkyTrak+ system outdoors to avoid getting the SkyTrak+ System wet from rain, snow, dew, water hoses, and other moisture sources.

DO NOT LEAVE THE SKYTRAK+ SYSTEM OUTDOORS WHEN NOT IN USE.
Take care not to spil any food of iquid on the SkyTrak+ system. Do not attempt to dry the Sky Trak+ ‘System with an extemal heat source, such as a microwave oven of hair dryer. A SkyTrak+ system damaged as a result of exposure to liquids is not serviceable.
Charging the SkyTrak+ System
In charging the SkyTrak+ System, use orly a SkyTrak+ supplied charger specificall designed for the SkyTrak+ system. Use of other chargers may cause personal injury and property damage, including damage to the SkyTrak+ system.
‘SkyTrak+ is not responsible for the operation of third-party accessories or their compliance with safety and reguiatory standards.
When charging the battery on the SkyTrak+ System with an authorized Sky Trak+ charger designed for use with the Sky Trake+ System, make sure that the charger is fully assembled before you plug it nto a power outiet: Do not connect or disconnect the charger with wet hands.
The charger may become warm during nomal use, however the SkyTrak+ System should never become hot. Always allow adequate ventiiation around the charger and use care when handing. Unplug the charger f any of the following conditions exist.

• The power cord or plug has become frayed or damaged
• The adapter is exposed to i, liquid or excessive moisture.
• The adapter case has become damaged,
• Yoususpect the adapter needs service of repair.

Exposure to Radio Frequency Energy
‘Your SkyTrak+ device contains radio transmitters and receivers, much like cell phones, pagers and other ‘smiar devices. When on, your SkyTrak+ device sends and receives radio frequency (RF) energy through its antenna. Your SkyTrak+ device is designed and manufactured to comply with applicable limits for exposure to RF energy.
Radio Frequency Interference
The SkyTrak+ system can emit radio waves that can affect the operation of nearby electronics, including cardiac pacemakers.

• Do notuse the SkyTrak+ system within nine (3) inches of a pacemaker.
• If you have a pacemaker or other implanted medical device, do not use the Sky Trak+ system without first consulting your doctor or the manufacturer of your medical device.

Setting Up Your Space for SkyTrak+

Before playing with Sky Traks the frst time, be sure to remove the protective fim from its optics lens and to full charge s batery.
To reduce the sk of injury or property damage, i is recommended that the Sky Trak+ system be setup using the guidelines below. Please ensure that you have created enough space around you to safely piay Wwith SkyTrak+ and that you heed allapplicable safety precautions at al times.

Consumer Limited Warranty

The folowing Consurmer Limited Waranty applies to your use of the SkyTrak+.
CONSUMER LIMITED WARRANTY SKYTRAK PRODUCTS
Authorized U.S. and Canada Units Only
GOLFTECST, LLC d/b/a SkyTrak. of 67 Invemess Drive East, Suite A, Engewood, CO 80112, (“SkyTrak”) or the (“Company”) provides a limited consumer hardware warranty to the original consumer (non- commercial) user (the “Customer”) of this SkyTrak+ product This limited warranty is non-transferable and does not extend to product used in any manner other than by an individual consumer in non-commercial use, all other warranties are exciuded as provided below.
WARNING: Golf can be a dangerous activity. When swinging a golf club or hitting a golf ball make sure you have ample space to do so without harming others or damaging property, and when indoors, take additional precaution to avoid hitting the ceiling. ALWAYS USE YOUR
SKYTRAK+ PRODUCT IN A SAFE AREA, AWAY FROM PEOPLE, ESPECIALLY SMALL CHILDREN, AND PROPERTY. WHEN HITTING GOLF BALLS INDOORS, INCLUDING YOUR GARAGE, ALWAYS USE A SAFETY NET SPECIFICALLY DESIGNED FOR USE WITH GOLF BALLS. Failure to follow these precautions can lead to serious injury or death to persons and damage to property.
When setting up your SkyTrak+ system for use, the SkyTrak+ device, your smartphone, tablet or computer and any playback device like your television, should be placed safely away from your hitting area and preferably safely to the side and behind the golf ball to prevent the gof club or golf ball, especially errantly hit golf balls, from damaging these devices.
SkyTrak assumes no liability or responsibility for the failure of the Customer to follow these precautions.
HARDWARE:
Subject to the exdusions, imitations, and condiions stated below, Sky Trak warrants that this Sky Trak+ product wil be free from defects in workmanship and materials, under nomal consumer (non-commercial) Use. for the lesser of (1) a period of six (6) months from the original purchase date or (2) a total of 25,000 shots taken on the SkyTrake product
AVAILABLE EXTENDED WARRANTY UPGRADE:
At the time of registration but within thity (30) days of original purchase, Custorners may optionally purchase a imited warranty upgrade to the lesser of (1) six (5) months from the original purchase date or (2) a total of 50,000 shots taken on the Sky Trake+ product The extended warranty does notinciude accessories and components.

LIMITATIONS AND EXCLUSIONS:
This warranty excludes (1) cosmetic or physical damage to the surface of the product, including cracks. or scratches; (2) normal wear and tear, (3) damage caused by misuse, neglect, improper instaliation or testing, unauthorized attempts to modify the product, attempted servicing by anyone other than an authorized service representative of SkyTrak or any other cause beyond the range of the intended use: (4) damage caused by accident, fire, water orliquids, power changes, other hazards, or acts of God: (S) use of the product with any non-SkyTrak component, such as chargers or Connection cables, or service if such component or senvice causes the probler (5) use of this product for any non-consumey, commercial orrental purpose: (7) damage caused by @ goif bal or golf club off the failure to use a propery piaced safety net, golf hiting mat or an authorized SkyTrak+ protective case: and (8) software installed on or with this SkyTrak+ product or any other device, Such as smartphones, tablets or computers. Any thirc-party products incuding software included with this Sky Traks+ product. are not covered by this Consurmer Limited Warrarty, and the Company makes o fepresentations or warranties on behalf of such thid parties. Any waranty on Suchthid party products i from the suppier or icensor of the third-party product Important: Do not open the SkyTrak:+ case. Opening the SkyTrak+ case may cause damage that s not covered by this warranty. Only SkyTrak or an authorized SkyTrak service center should perform service on this SkyTrak+ product. Opening the SkyTrak+ case shall void this warranty.
EXCLUSIVE REMEDIES AND PROCEDURE:
SkyTrak’s total obligation under this warranty shal be, at SkyTrak’s sole discretion, to repair or repiace: the product or part with a comparable product or part, of neither repair nor replacement is reasonably avalable, SkyTrak may refund to Customer the purchase price paid for the product or part. Replacement products or parts may be new or recondtioned. Parts removed by SkyTrak shall become the sole property of SkyTrak.
To obtain warranty service for SkyTrak products, the Customer must contact the SkyTrak customer service center noted below for a return authorization code, and return the unit shipping prepaid, with proof of the date of original purchase and return authorization code. Shipping labels must contain the return authorization code. ANY shipments sent for warranty service WITHOUT the appropriate retum authorization code will be refused and retumed to Customer at Customer’s expense. SkyTrak wil not be responsible for any loss or damage to the product incurred while the product s in transit from Customer for repairs. Customer should, as a precaution, purchase adequate insurance for the unitwhile itis in transit.
SkyTrak’s repair of replacement of defective parts does not extend the term of this Limited Warranty, which shal expire upon the expiration of the applicable Consumer Limited Warranty period from the date of original purchase.

LIMITATION OF LIABILITY:

SKYTRAK ASSUMES NO LIABILITY OR RESPONSIBILITY FOR INJURY OR DAMACE CAUSED BY SWINGING A GOLF CLUB OR BY AHIT GOLF BALL, AND THE CUSTOMER ASSUMES ALL. RESPONSIBILITY TO INSURE THE PROPER AND SAFE SETUP AND USE OF THE SKYTRAK SYSTEM.
EVEN IF SKYTRAK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, SKYTRAK’S ENTIRE UABILITY SHALL BE UMITED TO COSTS OF REPLACEMENT, REPAIR, OR REFUND OF THE PURCHASE PRICE PAID, AT THE SOLE OPTION OF THE COMPANY.

Any System Requirements set forth on Sky Trak+ packaging or othenwise relating to Sky Trak products that communicate with or connect to mobile devices, whether IS, Android™ or other, are minimum requirements only and compatibity with Specific devices meeting those System Requirements may vary by mobie device and its operating System, which changes often and outside the control of SkyTrak.
Accordingly. SkyTrak does not warrant that your Sky Trak+ product will function properly or achieve satisfactory performance while connecting via i0S or Android devices.
SPECIAL NOTE ABOUT ANDROID DEVICES: Performance of Android-based devices varies from device to device and from manufacturer to manufacturer. Consequently, SkyTrak CANNOT AND DOES NOT GUARANTEE THAT THE PRODUCTS WILL FUNCTION PROPERLY OR COMPLETELY WITH ANDROID-BASED DEVICES, ALL WARRANTIES WITH RESPECT TO YOUR SKYTRAK+ PRODUCT SHALL BE LIMITED BY THE FOREGOING COMPATIBILITY RESTRICTIONS, To see a st of currently compatible mobie devices, goto www.skytrakgolf.com.

WARNING PROCEEDING WITH USE OF THE SKYTRAK* PRODUCT CONTAINED WITHIN THE PACKAGE THAT INCLUDES THIS LICENSE AGREEMENT (SUCH SKYTRAK+ PRODUCT, TOGETHER WITH TS EMBEDDED SOFTWARE IS REFERRED TO AS THE “SKYTRAK+ PRODUCT) OR THE INSTALLATION ON A PERSONAL COMPUTER OR A SMARTPHONE, TABLET COMPUTER OR OTHER MOBILE DEVICE OF SOF TWARE ASSOCIATED WITH THE SKYTRAK+ PRODUCT (SUCH SOF TWARE AND THE SKYTRAK+ PRODUCT ARE SOMETIMES SINGLY AND COLLECTIVELY REFERRED TO AS THE “PRODUCTS’) INDICATES YOUR ACCEPTANCE OF THESE LICENSING TERMS. In the event you did not purchase the SkyTrak+ Product in an authorized E.U./U.K. sale or were nota resident of an E.U. member state or the U.K. at the time of purchase or do not have an address inan E.U. member state or U.K., no license is granted with respect to the Products, and you should contact Sky Trak Customer Service at customersupport@skycaddiegps.co.uk to apply for and arrange for a refund of your purchase within thirty (30) days of original purchase. An authorized E.U. sale means a transaction in which SkyHawke Tecnologies UK, Ltd. This Product Use and License Agreement (ths “License Agreement’) is a legal agreement between you and SkyTrak.
(Licensor). By using orinstaling the Products, you acknowledge and agree that you have read, understood and ‘agreed 1o this License Agreement and that this License Agreemment s enforceable ke any wiltten negotiated ‘agreement signed by you. Any and all software (including any embedded software, diivers, enhancements, revisions, downloads, modifications or updates), documentation and any fonts, whether on disk, i read orly memary, on any other media of n any other for, that efther came with the Sky Trak+ Product or is downioaded or provided in connection with the Sky Trake+ Product or a SkyTrak Subscripton Pian (collectivel, the “SkyTrak Software™ or “Software”) are licensed, not sold, to you by Licensor for use only under the terms of this License Agreement. and Licensor resenves al ights not expressly granted to you.

1. Gantof License — Licensor provides limited access to the SkyTrak Software and, in connection therewith, the Sky Trak infemet web site, and grants a imited icense for their Use Under the terms of this. License Agreement and, f separately purchased, the terms of your Sky Trak Subscription Plan. To the extent this License Agreement indludes the iicensing of Software or other components aiso icensed in connection with a Sky Trek Subscription Pian. you willlose access to such Software and other components on expiration of the temn of your Sky Trak Subscrption Plan f not timely renewed If you do not purchase a Sky Trak Subscription Pian, or f you purchase a Registration Only Subscription Plan the icense granted hereunder shal be imited in Scope to the use of the Sky Trak Software solely in connection with the basic driving range. and shall not include a icense to use the Sky Trak Software in connection with any other features or functionaity of the Sky Trak Software. Licensor reserves the gt tostop offering SkyTrak Subscription Pians and/or renewals, and to remove or imit the features or functionaity of Sky Trek Subscription Pians, at any time without notice. Addiionaly, some festures or functionaity of SkyTrek Subscription Plans, are dependent on icenses and agreements with third party providers, and Licensor reserves the right to remove from Sky Trak Subscripion Pins or not offer such third party provided features or functionality in the event Licensor’s agreement with such third party providers expies, teminates or is not renewed for any reason.
a Subjectto paragraph 5 below and the offher terms of this License Agreement, you are granted a nontransferable, non-exclusive license to use the Sky Trak Software under the terms stated in this 0License Agreement and. if purchased separately, the terms stated in your Sky Trek Subscription Pian0 License Agreement for solely personal noncommercial use in connection with the single Sky Trak Product Tite, ownership and copyright of the Sky Trek Software and any Scores, statistics and other information stored remain with, the Licensor. The rights granted herein are imited to the use of the Sky Trak Software accountin accordance with this License Agreement, and do not include any rights in any patents or otherintellectual property rights of Licensor.
b, Exceptas and only to the extent expressly peritted in this License or by appicable lw, you may not reverse engineer, decomple or disassermble SkyTrak Software, create SkyTrak Software dervative works, or attempt to create System Sky Trak source code from its object code. You may not:
(i) use any unauthorized, legal, counterfeit, or modified hardware or software with Sky Trak Software; (ii) use to0ks to bypass, disable, or circumvent any system encryption, secuiy, or authentication mechanism:  (iii) reinstall earfer versions of the SkyTrak Software (‘downgrading’) (iv) violate any laws, reguiations, or statutes or fights of SkyTrak or third parties in connection with your access to or use of SkyTrak Software; (v) use any hardware or software to cause SkyTrak Software to accept or Use unauthorized,
flegal or pirated software Or hardware; (vi) obtain SkyTrak Software in any manner other than though SkyTrak’s athorized distribution methods; of (vii) explolt Sky Trak Software in any manner other than to use itwith your SkyTrak+ system according to the accompanying documentation and with authorized software or hardware, indluding use of Sky Trak Software to design, develop, Update, of distibute unauthorized software or hardware for Use in connection with your SkyTrak+.
C. Youmay not assign, dstibute, lease, rent lend, sublcense, or transfer ths icense to the SkyTrak Software or any of their modules or components, except as provided herein o by tem (b) above. ot disciose the SkyTrak Software to any other person or ertity, or otherwise offer access to or use of the Sky Trak Software via the Intemet or via any other network which is available to or accessible by third parties. Any attempt to do Sois a violation of the fights of Licensor and s icensors of the SkyTrak Software. If you breach this restiction, you may be subject to prosectton and damages.
‘You may, however, make a one-time permanent transfer of al of your icense rights to the SkyTrak Software to another party in connection with the transfer of ownership of the Sky Trak+ Product. provided that (a) the transfer must include the Sky Trake+ Product and al of the Sky Trak Software, incuding alits component parts, original media, printed materials and this License: (b) you do not etain any copes of the SkyTrak Software, fullor parialincluding copies stored on a computer or other storage device: (c) the party receiving the Sky Trak Software reads and agrees to accept the terms and condtions of this License and (d) the tansfer s not of 2 commercial nature: You agree to reasonably cooperate with Licensor ininquires by Licensor regarding your downloading of Sky Trak Software.
d. Youagree that Licensor may, from time to time, send communications to you regarding (i) your Sky Trak+ Product, (ii) the Sky Trak Software, (iii) other nofifications relevant to the Sky Trak+ Product you have registered with Licensor, and (iv) special product or Service promotions or offers. These communications may come from either Licensor directly or through third parties providing mermber benefit services for Licensor. This permission Supersedes any previous opt outs by you.
e This License Agreement s effective unti expiation, unless sooner terminated by Licensor. To the extent this License Agreementincludes the icensing of Software or other components aiso icensed in connection with a Sky Trak Subscription Pian, this License Agreement with respectto such Software or other components expires simultaneously with the expiiation of such Subscription Pian or mobie appiication, respectively. Additionaly, this icense terminates, without notice, if you fail to comply with any provision of this Agreement. You agree Upon expication o temination to destroy the SkyTrak Software, together with al copies, modiications and merged portions in any form, induding any copy in your computer memory or on a hard disk.
f. Notwithstanding any provision to the contrary herein, the license granted hereunder shall only apply to the extent the Sky Trak+ Product on which the Sky Trak Software s installed was purchased by you in an authorized European Union/UK. sale, you were a fesident of an E.U. mermber state or the UK atthe time you purchased the SkyTrak+ Product and you registered the Sky Trake+ Product using your bona fide E U, member state or UK. address. Postal boxes or other similar addresses shall not qualfy as a bona fide .U, member state or UK. address, and addresses obtained, rented or leased from third parties for the purpose of receiving product for subsequent delivery outside the EU. or UK. shall not qualfy as a bona fide EU. member state/UK. address. In the event you did not purchase the SkyTrak+ Product in an authorized EU. sale or were not a £.U. mermber state or UK. resident at the. time of purchase or do not have an EU. member state of UK. address, no icense is granted to the Sky Trak Software, and if you purchased the SkyTraks Product drectly from Licensor via the Licensors Intemet web st then you shoud contact the:
Customer Sewvice department at customersupport@skycaddiegps co.uk to apply for and aange for a refund of your purchase wittin thirty (30) days of original purchase. In the eventyou did not purchase the Sky Trake+ Product in an athorized E.U,/UK. sale. were not a U member state or UK resident at the time of purchase or do not have an E. U, member state or UK. address and you did not purchase the SkyTrak+ Product directly from Licensor, then you shouid contact the sell.
2. UMITATION OF LIABILITY
LICENSOR PROVIDES THE SKYTRAK SOFTWARE ON AN “AS IS” BASIS AND DOES NOT WARRANT THE EXECUTION OR PERFORMANCE OF THE SOFTWARE. NO WARRANTIES ARE EXPRESSED AND NONE SHALL BE IMPLIED. LICENSOR SPECIFICALLY. EXCLUDES ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES SO THE FOREGOING MAY NOT APPLY TO YOU. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LICENSOR OR A LICENSOR AUTHORIZED REPRESENTATIVE SHALL CREATE AWARRANTY. SHOULD THE SKYTRAK SOFTWARE PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. NO REFUNDS SHALL BE GIVEN FOR SKYTRAK SOFTWARE, OR FOR SUBSCRIPTION FEES PAID FOR PREMIUM SERVICES. IN NO EVENT SHALL LICENSOR’S LIABILITY TO YOU FOR DAMAGES HEREUNDER FOR ANY CAUSE WHATSOEVER EXCEED THE AMOUNT PAID BY YOU FOR USE OF THE SOFTWARE. IN NO EVENT WILL LICENSOR BE LIABLE FOR ANY LOST PROFITS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMACES.
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMACES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE ANY SKYTRAK PRODUCT, SKYTRAK SOF TWARE AND SOF TWARE UPDATES, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF ‘SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
THE SKYTRAK SOFTWARE IS NOT INTENDED FOR USE IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAF T NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CCONTROL SYSTEMS, LIFE SUPPORT MACHINES OR OTHER EQUIPMENT IN WHICH THE FAILURE OF THE SKYTRAK SOF TWARE COULD LEAD TO DEATH, PERSONAL INJURY, OR
SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE.
Please be advised that golf is an inherently dangerous activity, and use of the Sky Trak+ is atyour own fisk.
3. Export Control — You may notuse or othenwise export or re-export the Sky Trak Software except as ‘authorized by appicable law. In particular, but without imitation, the Sky Trak Software may not be ‘exported or re-exported (a) into any embargoed countries of (b) to anyone on a governmental agency’s it of persons to whom export i resticted. By using the Sky Trak Software, you represent and warrant that you are notlocated in any such country or on any such st You also agree that you wil notuse the SkyTrak Software for any puroses prohibited by applicable aw, including, withoutmitation, the development. design, manufacture or production of missies, nuclear, chemical or biological weapons. Use of some features and functionality of the Sky Trak+ Product and related accessories may be resticted by the laws of countries other than the country in which the Sky Trak+ Product and related accessories may be found You are solely responsible for determining whether use of al features ‘andfunctionaity of the Sky Trak Product and related accessories are pemitted in any country.
4. US Govemment Resticted Rights (f applicable) — The Sky Trak Software is provided with RESTRICTED RIGHTS, Use, duplication or disclosure by the U’S. Govemment s subject to restictions setforth in subdivision (¢) (1) of The Rights in Technical Data and Computer Software ciause at ‘252.227-703 Contractor/Manufactureris Sky Trak, 67 Invermess Drive East. Suite A Engewood. CO 8012
5. Requiement to Purchase a SkyTrak Software Application and Relationship to Apple. Inc. and/or Google — The Sky Trak+ Product wil not be functional except when used in connection with SkyTrak Software Appiication purchased through the Apple App Store or Google Play and installed on a compathble mobie device. The Apple App Store is a service of Apple, Inc. and Google Play is @ senvice of Google, Inc, and nefther is a service of Licensor. Licensor has no control over, and shall have no responsibility o liabilty for, operation of, or the inability to access, the Apple App Store or Coogle Play or download software or other applications from the Apple App Store or Google Play. This License Agreement, and your use of the SkyTrak+ Product and the SkyTrak Software, is subject to any icense or Usage agreement you entered in connection with the purchase, downoad, installation or use of any software application purchased through the Apple App Store or Google Play. With respect to SkyTrak Software that constitutes a SkyTrak Software Appication purchased, downioaded, installed or otheise obtained through the Apple App Store or Google Play (each of which is hereater referred to as the “App Service Provider”), the folowing additional terms and conditions apply:
a. This License Agreement is an agreement between you and Licensor only, but the App Sewvice: Provider (induding tts subsidiares) is a third party beneficiary hereto and shail have the fight (and wil be deemed to have accepted the dight) to enforce this License Agreement as a third party beneficiary hereof.
b. Licensor, and not the App Service Provider, s solely responsile for the Sky Trak Software Appication and the content thereof. Licensor, and not the App Service Provider, s solely responsble for maintenance of the Sky Trak Software Application: provided, however, the foregoing shallnot requie Licensor to perform maintenance with respect to the Sky Trak Software Applcation beyond that which Licensor othenwise expressly agrees to in this License Agreement or as required by applicable law. For the avoidance of doubt. the App Service Provider shall have no responsbilty to maintain the SkyTrak Software Application.
c. Notwithstanding any other provision in this License Agreement to the contrary, the iicense granted hereby to you for use of the SkyTrak Software Applcation i futher imited to a non-transferrabee icense to use the Sky Trak Software Appication on a compatible mobile device that you own or control and as permitted by the Usage Rules setforth in the App Service Provider Terms of Senvice.
d. Licensor, and not the App Service Provider is Solely responsible for any warranty that s provided toyou by Licensor and othenwise not disciaimed with respect of the Sky Trak Software Appication. The foregoing sentence is meant solely s an alocation of responsbilty between Licensor and the App Senvice Provider and shallnot be constiued as creating extending or othenwise modifying any warrarty or disdaimer of warranty Set forth in this License Agreement For the avoidance of doubt Licensors warranty for the Sky Trak Software Application isimited as set forth in Section 2 of this License Agreement and nothing in this Section 5 (d) shal alter, moify o otherwise affect such imitation in the eventthe Sky Trak Software Appication fais, within the warranty period, to conform to any appiicable ‘warranty which has not been propery disciaimed, you shouid promptly, and within the warranty period, notify the App Senvice Provider. To the extent permitted by appicable law, the App Sevice Providers ‘Soke warranty responsiilty with respect to such nonconforming SkyTrak Software Appication shal be torefund toyou the purchase price, if any, of such nonconforming Sky Trak Software Appication.
e. Licensor, and not the App Service Provider is solely responsible for addressing any daims relating tothe SkyTrak Software Appiication or your possession and/or use of the Sky Trak Software Appication, incuding, but not limited to, product iablty ciaims, any claims that the SkyTrak Software Appication fails to conform to applicable legal or reguiatory requirements and clams under any consumer protection o simiar legisiation. The foregoing sentence is meant solely as an alocation of responsiiity between Licensor and the App Senvice Provider and shall not be construed as creating or ‘extending liabilty to Licensor with respect to the Sky Trak Software Application, inciuding, without limitation, iabiity for the types of claims identified n the foregoing sentence. For the avoidance of doubt, Licensors labitty for any claims, including the types of ciams identified above, is imited as set forth in Section 2 of this License Agreement
f. The developer of the SkyTrak Software Appication is SkyTrek, 67 Invemess Drive East, Sute A Engewood, CO BOI12. For questions, ciaims or complaints about the SkyTrak Software Application. please contact Licensor’s Customer Service department at support@skytrakgolf.com.
6. Requirement to Purchase 3 Sky Trak Subscription Plan — Some or all of the SkyTrak Software may not be used without a current Sky Trak Subscription Plan, and no icense is hereunder granted thereto without a current Sky Trak Subscription Plan. To the extent any of the Sky Trak Software is indudedin a SkyTrak Subsciption Plan, you must separately purchase the Sky Trak Subsciption Plan, andthe use and license of such SkyTrak Software is subject to and govemed by the SkyTrak ‘Subscription Plan and any ficense agreement in connection with such Subscription Pian. If you do not purchase the SkyTrak Subscription Plan, you wil not have access to, and are not granted aicense hereunder for such Sky Trak Software, and the icense granted hereunder shal be imited in scope to the use of the SkyTrak Software solely in connection with the basic diiving range. Any features of the ‘SkyTrak Software, other than the basic diving range, that comes pre-loaded on your Sky Trak Product are for imited time trial only and may be removed at Sky Trak’s discretion f a Sky Trak Subscription Pan isnotpurchased.
7. Ownesship of Uploaded Data — You agree for and in consideration of Licensor offering to you the icense granted in accordance with the terms of this License Agreement. that any data upioaded by you to Licensor or to any website maintained by Licensor shal be and become the property solely of Licensor, and you hereby assign, convey and transfer to Licensor all of your ight. tite and interest in and to such ata,indluding. without imitation, any copyright or other intellectual property fights you may have insuch data
8 Choice of Law — This License Agreement is govemed by the laws of the State of Colorado, without fegard to the prindples of confict of laws. You acknowledge that the Software and updates ficensed under this License Agreement are provided thiough computer servers maintained in the State of Colorado, USA and that such jurisdiction has 2 Significant and meaningful connection with the transaction inwhich you obtained such Software and updates. This License shallnot be governed by the United Nations Convertion on Contracts for the Intemational Sale of Goods, the appication of which is expressly excluded. I for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this License Agreement shal continue in ful force and effect to the fullst extent peritted by law.
9. Complete Agreement — This License Agreement, together with any license agreement you entered in ‘connection with a Sky Trak Subscription Pian constitutes the entre agreement between the parties with fespect to the use of the Sky Trak Software icensed hereunder and supersedes al prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this License Agreement wil be binding uniess in wiing and signed by Licensor or unless posted on Licensor’s webste. Any tianslation of this License Agreementis done for local requirements and in the event of a dispute between the English and any non-Engish versions, the English version of this Uicense Agreement shal govem.
10. Beta Test Features — One or more features of the Products (including software applcations used in ‘connection with the Sky Trak+ Product) may be in beta test mode (the “Beta Features”). The use and continuation of these Beta Features are subject to this License Agreement As a beta tester, you are: invited to use the Beta Features.

The Beta Features are provided *AS IS” and “AS AVAILABLE.” andwe make no warranty of any kind, express or impled, with respect to the Beta Features. By using the Beta Features, you agree that (i) use of the Beta Features is at your own risk and for the purpose of evaluating the features and identifying errors, (i) the Beta Features may indude known and unknown bugs and (i) Licensor may discontinue or mody the Beta Features at any time and from time to time. Licensor makes no guarantee that the Beta. Features wil ever be released from beta testing as a ful feature for use with the Sky Trake+ Product The Beta Features may intialy be provided free of charge. Licensor may, at any time, discontinue any such free use and may, at any time and from e to time, make access to o Lse of the Beta Features (and the features upon ful release) subjectto payment of addiiona fees or costs.
