Riding Safety

PLEASE PROPERLY FOLLOW THE INSTRUCTION ON SAFE RIDING IN THIS USER MANUAL. PLEASE ENJOY THIS KickScooter RESPONSIBLY, SAFELY AND PROPERLY. FAILURE TO COMPLY WILL INCREASE RISK OF FALL AND/OR ACCIDENT WHICH MAY CAUSE SEVERE CONSEQUENCES, SUCH AS PROPERTY DAMAGES, BODILY INJURY, SEVERE BODILY INJURY, OR EVEN DEATH

Riding

  1. A user may only ride this KickScooter on road, if it is allowed by local law and/or regulation. A user shall ride this KickScooter in compliance with all applicable law and/or regulation. DO NOT trespass on private land / premise. This KickScooter shall not be ridden indoors.
  2. This Kickscooter can be used by children aged from 14 years to 60 years. Persons with limited physical, sensory, mental capabilities, or a lack of experience, should have supervision or instruction regarding use of the appliance in a safe way, without any hazards involved. Children shall not play with the appliance. Cleaning and user maintenance shall not be made by children without supervision. This KickScooter is intended to carry one rider only, no passenger.
  3. DO NOT accelerate or brake abruptly when riding.
  4.  Please use two hands to hold the handlebar and use two feet standing on the KickScooter to reduce risk of loss of balance.
  5. Fast speed requires a longer brake distance and increases risk of fall and/or collision.
  6. Always slow down to prepare for making turns, merging onto another lane, avoiding obstacles or pothole on road or collision. Slow down when approaching intersections, motorways, corners, slippery or difficult road condition, or entering into an unfamiliar environment.
  7. DO NOT ride at unsafe speed, and a user shall always use his / her best judgment to ride responsibly, safely and properly.
  8. Stay alert to environment and ride defensively. Always keep a safe distance from the others (e.g., motor vehicles and pedestrian). Please avoid crowded areas.
  9. A user shall notify his / her presence when approaching another person and/or vehicle, especially when a user of this KickScooter is at blind spot of the others and/or may not be noticed by the others.
  10. Yield the right of way when it is required by law to reduce risk of collision, fall or other accident.
  11. The KickScooter is designed to be ridden on a dry, flat, hard-surface, free of obstacles, bumps, holes, and other hazards (for details please refer to the KickScooter’s Specifications provided in the user manual). Please avoid riding over obstacles, on uneven ground, pothole, slippery surfaces, loose ground, steep slope. DO NOT ride on any ramp or incline that exceeds the maximum slope.
  12. DO NOT use a cell phone, camera, headphones, earbuds and/or perform any other activities that may cause distraction while riding.
  13. DO NOT ride in bad weather such as snowing, raining or strong wind.
  14. DO NOT ride on wet, muddy, icy, and/or slippery road condition.
  15. DO NOT allow the KickScooter to get wet. You risk damage to the batteries and potential for a fire or explosion due to a wet battery pack.
  16. DO NOT ride the KickScooter after sunset (unless it is permitted by local law) or when visibility is so low that a user cannot ride safely.
  17. DO NOT ride the KickScooter too close to water source.
  18. If any abnormality occurs (e.g., abnormal sound, shaking, smoke or error code or signal on the dashboard), a user shall stop riding immediately and contact after-sales service immediately. DO NOT use the KickScooter until cause of the abnormality is found out and repaired by an authorized service center or the after-sales service.
  19. DO NOT touch moving or spinning tires.
  20. After riding the KickScooter, DO NOT touch the brake system, as sharp edges may cause injury and/or brake may be hot.
  21. Stop using this KickScooter immediate and take other means of transportation available whenever you feel uncomfortable or have any concerns.
  22. Stop using this KickScooter immediately if the throttle gets stuck.
  23. Long time use of the scooter may cause the throttle to get stuck. If this happens, stop using the KickScooter immediately and contact the after sales service for maintenance.

Preparation for Riding

  1. Make sure the handlebar is stable, the steering system is correctly adjusted, and suitable for use. Check to make sure the front and rear wheels are not shaky or loose. Make sure there are no loose fasteners or damaged.
  2. Make sure the front and rear brakes can work normally. Make sure the brake function and mechanism work properly.
  3. Make sure all connections and the folding mechanism are correctly tightened and not broken. Check the brakes and wheels and confirm they are in good condition. The self-tightening nuts as well as the other self-tightening fastenings may lose their efficiencies and may need to be retightened.
  4. Check the status of the battery level, lighting, dashboard display, etc. and make sure they work normally.
  5. Make sure the reflectors are not damaged or dirty.
  6. Make sure tire performance and condition is normal and suitable.
  7. Make sure all the other functions and parts of the KickScooter work normally.
  8. Abnormality (such as error code, shaking, noise and/or smoke from motor), discoloration or change of color of material (especially in an area that receives high stress when the KickScooter is in motion or function), scratch, crack, loose fasteners, and/or missing parts (such as screw, bolts and/or nut) strongly indicate that it is not safe to ride the KickScooter.
  9. Eliminate any sharp edges caused by use.
  10. Always wear appropriate shoes, clothing, helmet, and protective gear (such as knee pads and elbow pads) when riding. Use an approved bicycle or skateboard helmet that fits properly with the chin strap in place and protects the back of your head. Remove or tie back anything loose (i.e., clothing, hair, jewelry, etc.) that could be caught in any moving parts.
  11. DO NOT turn on the KickScooter unless it is parked on flat ground.
  12. DO NOT carry and/or attach any object on the handlebar. Any load attached to the handlebar will affect the stability of the KickScooter, which increases risk of fall, injury and more severe consequences.
  13. DO NOT carry heavy backpack and DO NOT carry luggage and/or cargo, which increases risk of loss balance, distraction, fall, collision and other accident.
  14. DO NOT ride when the ambient temperature is outside the machine operation temperature (see Specifications), because low/high temperature will limit the maximum power/torque.
  15. For your safety and for a better riding experience, please conduct regular maintenance on the KickScooter, and also assure that the KickScooter shall be inspected and repaired by an authorized service center and/or technician regularly and as needed. For more information, please refer to “Maintenance and Care” and “Recommended Maintenance Schedule”.
  16. Make sure that a user carefully read and understands the user manual and how to properly operate and/or operate the KickScooter before riding the KickScooter.

Parking
Always park with the kickstand on a flat and stable surface. Once the KickScooter is on its stand, check its stability to avoid any risk of falling (by slip, wind, or slight jolt). Do not block the road, entrance, and/or park it at a place that is prohibited by law and/or dangerous to yourself and/or others. To prevent theft of the KickScooter, the rear wheel of the KickScooter must be locked with a padlock when parked.

Who may not ride
Due to its strong power source and maximum speed capacity, a user must be at least fourteen (14) years old to ride this KickScooter.
The following individuals or an individual in the following circumstances shall not ride this KickScooter:

  1. Anyone under the influence of alcohol, drugs, or intoxicants.
  2. Anyone who does not have sufficient mental capacity to understand this user manual and/or ride this KickScooter responsibly, properly and safely.
  3. Anyone who suffers from a disease that puts himself/herself at risk if he/she engages in strenuous physical activity.
  4. Anyone whose weight and/or height is outside the stated limits (see Specifications).
  5. Anyone who is more vulnerable than average to injury and/or fall accident that may be caused in connection with this KickScooter due to his / her physical and/or heath condition and/or occupation.
  6. Pregnant women.

Law and Insurance Disclosure

A user shall check and obey local laws and/or regulations in connection with ownership and use of the KickScooter. It is a user’s sole responsibility to ride, use and/or dispose of the KickScooter in compliance with such laws and/or regulations. The law and regulations may be different in different states, jurisdictions and/or countries. Apart from the others, such law and regulation may include: (1) A helmet may be required by local law or regulation. (*You are always required by this user manual to wear helmet and proper protective gear unless it is prohibited by law or due to special reasons, using helmet and protective gear is likely to cause more harm.) (2) this KickScooter may be required to be registered and/or a license by local law or regulation. (3) This KickScooter may not be allowed to be ridden on road or on certain road. For more information related to legal and/or mandatory compliance requirements on use and ownership of this KickScooter, please consult and check your local law.

Maintenance and Care

For your safety and better riding experience, please conduct regular maintenance of the KickScooter.
Please be extremely careful and prevent injury to yourself and others or damage to property and/or your KickScooter. If you do not understand how to conduct maintenance and care per this user manual or have question about it, please contact the after-sales team and/or an authorized service center for assistance. You can find an authorized service center by visiting https://store.segway.com/warranty-information or contact Segway after-sales services. Make sure the KickScooter is powered OFF, the charge cable is unplugged, and the rubber cap on the charge port is tightly sealed before cleaning and/or conducing maintenance; otherwise, you may expose yourself to electric shock or damage the electronic components.

KickScooter exposed to water or rain.
If the KickScooter is exposed to rain and/or water, which may be beyond its water-proof capacity, please store it outdoors at a proper place away from buildings and people until it is dry. Thereafter, please contact the after- sales team and/or an authorized service center and/or technician for inspection and repair (if necessary). Do not attempt to disassemble the KickScooter for the purpose of wipe dry, inspecting and/or repair.

Cleaning
Warning:

  1. If you need to clean the KickScooter, use a soft, wet cloth to wipe the mainframe clean. Dirt hard to remove can be scrubbed with a toothbrush and toothpaste, then cleaned with a soft, wet cloth. DO NOT rinse the KickScooter.
  2. DO NOT clean this KickScooter by alcohol, gasoline, acetone, or other corrosive/volatile solvents. These substances may cause damage and corrosion of the appearance and internal structure of the KickScooter.
  3. DO NOT wash your KickScooter with a power washer. DO NOT use a strong water flow or high-pressure hoses to clean the KickScooter. Avoid getting water in the charge port.

Battery recharging and Maintenance
WARNING

  1. ONLY use the original charger. DO NOT immediately recharge the KickScooter after riding, please allow the KickScooter to cool down by time. Do not attempt to charge the KickScooter, if the charger and/or the power outlet is wet.
  2. For the purposes of recharging the battery, only use the detachable supply unit provided with this appliance. This appliance contains batteries that are not replaceable. The appliance is to be used with the battery charger provided with the appliance.
  3. As with any electronic device, please use a surge protector when recharging, as it will help protect the KickScooter and/or battery from damage due to power surges and voltage spikes.
  4. Keep away from combustible materials when charging, and disconnect from the power supply once it’s fully charged
  5. Only use the original battery by the manufacturer.
  6. DO NOT store or charge the battery at temperatures outside the stated limits (see Specifications).
  7. DO NOT puncture the battery. DO NOT attempt to disassemble the battery. DO NOT touch battery contacts. DO NOT dismantle or puncture the casing.
  8. Keep the battery contacts away from metal objects to prevent short circuit. Risk of fire. No user serviceable parts.
  9. DO NOT charge or use your battery if it is damaged or see a trace of water.
  10. DO NOT expose the battery to fire. DO NOT discard or destroy the battery.
  11. Charge the battery after each ride / use to avoid draining the battery completely. Please read the user manual before charging the battery.
  12. Refer to your local laws and regulations regarding battery recycling and/or disposal.

Storage
Store your KickScooter indoors. DO NOT store it outdoors for extended periods. The KickScooter should be stored in an environment where the temperature is no higher than 113°F (45°C) or lower than -4°F (-20°C). If the temperature of the storage environment is lower than 32°F (0°C), DO NOT charge it until after placing it in a warm environment (over 50°F (10°C).

NOTE

  1. When the scooter is powered off, it will still cause battery consumption. If the scooter is not in use for a long time, charge the battery to 50% or above before storage. It’s recommended to charge the battery once every 30 to 60 days, or it may cause damage to the battery performance due to over-discharge. Electronics inside the battery record the
    charge-discharge condition of the battery, and any damage caused by over- charge or over-discharge will not be covered in the product warranty.

  2. A well-maintained battery can perform well even after many miles of riding. When used at a room temperature (77°F
    [25°C]), its battery range and performance are at its best; whereas used at a temperature below 32°F (0°C), its battery range and performance may decrease. Typically, the battery range is affected by the temperature. The low temperature will reduce the battery range.

Others:

  1. The A-weighted emission sound pressure level is less than 70 dB(A). The mechanical vibrations transmitted by the KickScooter are less than 2.5 m/s². The uncertainty of measurement: 1.5 m/s².
  2. The use of the machine results in the transmission of vibrations throughout the rider’s body.
  3. Class 2 PLEV reference to EN 17128: 2020.

WARNING! As with any mechanical component, this KickScooter is subject to high stresses and wear and tear. The various parts and components may react differently to wear, tear and/or fatigue. Overuse of the KickScooter (i.e., the KickScooter, its parts and/or components are used beyond its reasonably expected service life) increases risk of product failure, which may cause severe consequences such as bodily injury, severe bodily injury, death and/or property damages. Cracks, scratches and discoloration in the areas subject to high stresses indicate that the component has exceeded its service life and should be inspected and replaced. Notably, wear, tear, fatigue and/or overuse of parts and/or components may occur without observable appearance change of such parts and/or component. Furthermore, certain issues (especially for those at early stage) caused by use of this KickScooter may only be identified via professional inspection and examination. To reduce risk of accident that may be caused by wear, tear, fatigue and/or the similar, please refer to “Recommended Maintenance Schedule” and get timely replacement for exhausted components/parts/accessories. DO NOT overuse any component that has exceeded its service life. Notably, a user shall immediately refrain from riding this KickScooter and have it inspected and repaired (if necessary), if a user has concern over safety and/or performance of this KickScooter regardless the schedule below.

Legal Statement

IMPORTANT: A user shall carefully read the entire User Manual and fully understand it (especially for the content related to warnings, caution statements, product operation and safety), and adhere to the foregoing instructions herein before using this KickScooter. A user shall always use his / her common sense and best judgment when using the product. An owner of this product shall not allow anyone and/or cause another person to use it unless that person is clearly informed of the foregoing warnings and agrees to comply with it.

  1. Upon receipt of the product, a buyer or recipient of this KickScooter shall immediately check whether the KickScooter and its accessories are in good condition upon receipt of the KickScooter.

  2. All the separate components and parts of the KickScooter must be properly installed per the user manual. Inappropriate installation and/or assembly may damage the product, significantly increase risk of loss of control, product failure, collisions, and/or falls.

  3. The KickScooter may contain removable components and small parts, which can create a choking hazard. Keep plastic covering away from children to avoid suffocation. Keep children away from the KickScooter, its package, covering and/or parts to avoid the foregoing risk.

  4. This KickScooter is a personal use electric kick scooter. It is NOT for commercial use. It is for ordinary recreational purpose and short distance personal transportation purpose, provided that local law and regulation permits use of this product on road. The KickScooter shall NOT be used for extreme sports, high risk sports and/or performance, stunt, road racing, skill and/or performance competition and/or contest, similar activities, and/or any other purposes that may expose a user and/or others unreasonable or high risk of injury and/or damages.

  5. Using this KickScooter involves risk of injury and/or loss to a user and/or the others, including but not limited to bodily injuries, severe bodily injury, death, and/or damages to property. Understanding operation and features of this KickScooter and following safety instructions would help to reduce risk of accident, but it cannot eliminate all risk. By using this KickScooter, a user agrees to assume all risk related to this KickScooter, known and unknown, such as risk caused by product failure, third party conduct, and/or a user’ s conduct (including negligence).

  6. A user may not have necessary and sufficient experience, competency, ability and/or skills to use the KickScooter and/or ride it at its maximum capacity (e.g., at the highest speed), especially in complex and/or undesirable road condition and/or environment. The risk may increase, if a user is not sufficiently familiar with the KickScooter’s functions, features, and performance (such as its maximum performance capacity and performance limits). Thus, a user, especially new users, shall learn and practice on proper and safe use of KickScooterin a safe environment and in a safe manner. Assistance and/or supervision may be desired for new users. Provided that the KickScooter is permitted to be ridden on road by local law and/or regulation, a user shall not attempt to ride on road unless he / she is sufficiently familiar with the KickScooter so that he / she can safely and properly ride the KickScooter on road. Experience accumulated by practice would normally enable a user to better ride and operate the KickScooter by time. A user shall assume all risk of loss in connection with the foregoing risk.

  7. The parts and components of the KickScooter are subject to fatigue, wear and tear. Many factors, such as environment, aging, road conditions and/or riding behaviors may affect the rate of wear and tear. Wear and tear may cause unanticipated and/or sudden failure of the KickScooter, which may cause, inter alia, property damages, severe bodily injury and/or even death. To reduce such risk, a user shall regularly and periodically, as circumstance requires, properly inspect and maintain the KickScooter. A user shall also conduct reasonable examination and inspection of the KickScooter every time before riding it.

  8. Since it is impossible to predict and/or anticipate all and every scenario, condition, and/or circumstances under which a KickScooter user may be exposed to risk and danger, the user manual is not intended to be an exhaustive list on how to ride the KickScooter safely and/or avoid hazards related to the KickScooter. So, in addition, to adhere to the instructions, the user shall also ride and/or use the KickScooter with responsibility, carefulness, precaution, and best judgment. The user should always be a responsible rider, cautious, maintain proper speed and avoid all dangerous riding behaviors, as well as traffic and/or road conditions when riding the KickScooter. For instance, you shall avoid speeding, overloading or performing stunts of any kind. Do not try to touch the tires with your hands or feet when riding. The KickScooter is for one rider only.

  9. The KickScooter is a complex electronic and mechanic device. No one shall modify this KickScooter (including its software) and/or enhance its performance capacity exceeding its maximum capacity recommended/permitted by this use manual. No one shall conduct reverse engineering on the KickScooter. Only an authorized and professional mechanics, technician, and/or services provider may dismantle and/or disassemble this KickScooter. Violation of the foregoing will result in loss of any and all product warranty and may cause severe consequences, such explosion, fire, and/or severe bodily injury or death.

  10. Do not dispose of this KickScooter in landfill, by incineration, or by mixing with household trash. Serious danger / injury can occur because of the electrical components and the battery. For information about battery and electrical waste, please contact your household waste disposal service, your local or regional waste management office, or your
    point-of-sale. The user shall not use any non-original accessories or dismantle or modify the KickScooter without authorization. All damages, injuries, and damages to property arising from that place will be your sole responsibility and risk.

  11. The manufacturer and/or Segway reserve the right to make changes to the KickScooter, release firmware updates, and update this manual at any time. The manufacturer and/or Segway may make improvements, update and changes to the user manual due to typographical errors, inaccuracies of current information, new development and finding, or modifications to programs and/or equipment at any time upon notice. The manufacturer and/or Segway reserves the right to select proper way of notice such as via email, App, on Segway’s website and/or updated e-copy of the user manual that is published on Segway’s website. All illustrations and pictures are for illustration purposeonly and may vary from actual device.

  12. This is NOT a medical device, and it is NOT approved by any authority or association for any medical purpose.

  13. This document should be considered as a permanent part of the KickScooter, and it shall be provided to a user together with the KickScooter all the time.

Riding Safety

  1. The KickScooter is a recreational product. Before mastering riding skills, you need to practice. Neither Ninebot Inc. (means Ninebot (Beijing) Tech Co., Ltd. and its subsidiaries and affiliates) , hereinafter referred to as, collectively, Ninebot Inc. nor Segway Inc. is responsible for any injuries or damage caused by a rider’s inexperience or failure to follow the instructions in this document.

  2. Please understand that you can reduce the risk by following all the instructions and warnings in this manual, but you cannot eliminate all the risks. Remember that whenever you ride the KickScooter you risk injury from loss of control, collisions, and falls. When entering into public spaces always comply with the local laws and regulations. As with other vehicles, faster speeds require longer braking distance. Sudden braking on low traction surfaces could lead to wheel slip, or falls. Be cautious and always keep a safe distance between you and other people or vehicles when riding. Be alert and slow down when entering unfamiliar areas.

  3. Always wear a helmet when riding. Use an approved bicycle or skateboard helmet that fits properly with the chin strap in place, and protects the back of your head.

  4. Do not attempt your first ride in any area where you might encounter children, pedestrians, pets, vehicles, bicycles, or other obstacles and potential hazards.

  5. Respect pedestrians by always yielding the right of way. Pass on the left whenever possible. When approaching a pedestrian from the front, stay to the right and slow down. Avoid startling pedestrians. When approaching from behind, announce yourself and slow down to walking speed when passing. Please obey local traffic laws and regulations if the situation is different.

  6. In places without laws comply with the safety guidelines outlined in this manual. Neither Ninebot Inc. nor Segway Inc. is responsible for any property damage, personal injury/death, accidents, or legal disputes caused by violations of the safety instructions.

  7. Do not allow anyone to ride your KickScooter on his/her own unless they have carefully read this manual. The safety of new riders is your responsibility. Assist new riders until they are comfortable with the basic operation of the KickScooter. Make sure each new rider wears a helmet and other protective gear.
    8. Before each ride check for loose fasteners and damaged components. If the KickScooter makes abnormal sounds or signals an alarm, immediately stop riding. Call your dealer/distributor for service.
    9. Be alert! Scan both far ahead and in front of your KickScooter — your eyes are your best tool for safely avoiding obstacles and low traction surfaces (including, but not limited to, wet ground, loose sand, loose gravel, and ice).

  8. To reduce the risk of injury, you must read and follow all “CAUTION” , “WARNING” and ” ” notices in this document. Do not ride at an unsafe speed. Under no circumstance should you ride on roads with motor vehicles. The manufacturer recommends riders be 14+ years old. Always follow these safety instructions:

    • A. People who should not ride the KickScooter include:
    1. Anyone under the influence of alcohol or drugs.
    2. Anyone who suffers from a disease that puts them at risk if they engage in strenuous physical activity.
    3. Anyone who has problems with balance or with motor skills that would interfere with their ability to maintain balance.
    4. Anyone whose weight is outside the stated limits (see Specifications).
    5. Pregnant women.
    • B. Comply with local laws and regulations when riding this product. Do not ride where prohibited by local laws.
    • C. To ride safely, you must be able to see what is in front of you and you must be visible to others.
    • D. Do not ride in the snow, in the rain, or on roads which are wet, muddy, icy, or that are slippery for any reason. Do not ride over obstacles (sand, loose gravel, or sticks). Doing so could result in a loss of balance or traction and could cause a fall.
  9. Do not attempt to charge your KickScooter if, the charger or the power outlet, is wet. Please read the user materials before charging the battery.

  10. As with any electronic device, use a surge protector when charging to help protect your KickScooter from damage due to power surges and voltage spikes. Only use the original supplied charger. Do not use a charger from any other product models.

  11. Use only Ninebot or Segway approved parts and accessories. Do not modify your KickScooter. Modifications to your KickScooter could interfere with the operation of the KickScooter, could result in serious injury and/or damage, and could void the Limited Warranty.

  12. Children should not play with the KickScooter or parts of it nor should cleaning or maintenance be done by children. The use of the machine results in the transmission of vibrations throughout the driver’s body.

  13. Always place the KickScooter on its kickstand on a flat and stable surface. The KickScooter must be placed with the kickstand against the slope to prevent it from tipping over. Never place the KickScooter with the front facing down the slope, which may cause your vehicle to tip over. Once the KickScooter is stably parked, check its stability to avoid any risk of falling (by slip, wind or slight jolt). Do not park the KickScooter in a busy area, but rather along a wall.

  14. For a better riding experience, it is recommended to conduct regular maintenance of the KickScooter.

  15. Do not touch the brake system, it could cause injuries.

  • Be sure the KickScooter is powered off before performing any maintenance or when installing or replacing parts.
  • When installing components, use proper and sufficient force until the component is secure. If the installation is too loose or too tight, the KickScooter may not function properly resulting in the potential for injury to you or others or damage to, or malfunction of, the KickScooter.
  • DO NOT modify your KickScooter. Modifications to your KickScooter could interfere with the operation and performance of the KickScooter, which may result in serious injury and/or damage, and could void the Limited Warranty. Only use Ninebot or Segway approved parts and accessories.

Cleaning
Use a soft, wet cloth to wipe the mainframe clean. Dirt hard to remove can be scrubbed with a toothbrush and toothpaste, then cleaned with a soft, wet cloth.

WARNING

  1. Make sure the KickScooter is powered OFF, the charge cable is unplugged, and the rubber cap on the charge port is tightly sealed before cleaning; otherwise you may expose yourself to electric shock or damage the electronic components.
  2. DO NOT wash your KickScooter with alcohol, gasoline, acetone, or other corrosive/volatile solvents. These substances may damage the appearance and internal structure of your KickScooter.
  3. DO NOT wash your KickScooter with a power washer. DO NOT use a strong water flow or high-pressure hoses to clean the KickScooter. Avoid getting water in the charge port. If your KickScooter has been exposed to heavy rain store it outdoors away from buildings and people but protected from the elements until it is dry.

Storage
Store your KickScooter indoors. DO NOT store it outdoors for extended periods. The KickScooter should be stored in an environment where the temperature is no higher than 122°F (50°C) or lower than 14°F (-10°C). If the temperature of the storage environment is lower than 32°F (0°C), DO NOT charge it until after placing it in a warm environment (over 50°F (10°C).
WARNING: Exposure to sunlight and temperature extremes (both hot and cold) will accelerate the aging process of the plastic components and may reduce battery life.

Battery Maintenance

  1. Only use the battery specified by the manufacturer.
  2. DO NOT store or charge the battery at temperatures outside the stated limits (see Specifications).
  3. DO NOT puncture the battery. DO NOT attempt to disassemble the battery. DO NOT touch battery contacts. DO NOT dismantle or puncture the casing.
  4. Keep the battery contacts away from metal objects to prevent short circuit. Risk of fire. No user serviceable parts.
  5.  DO NOT charge or use your battery if it is damaged or see a trace of water.
  6. DO NOT store or charge the battery at temperatures outside the stated limits (see Specifications). DO NOT expose the battery to fire. DO NOT discard or destroy the battery.
  7. Charge the battery after each ride and avoid draining the battery completely. Please read the user materials before charging the battery.
  8. Refer to your local laws and regulations regarding battery recycling and/or disposal.

NOTE

  1. When the scooter is powered off, it will still cause battery consumption. If the scooter is not in use for a long time, charge the battery to 50% or above before storage. It’s recommended to charge the battery once every 30 to 60 days, or it may cause damage to the battery performance due to over-discharge. Electronics inside the battery record the charge-discharge condition of the battery, and any damage caused by over-charge or over-discharge will not be covered in the product warranty.
  2. A well-maintained battery can perform well even after many miles of riding. When used at a room temperature (77°F
    [25°C]), its battery range and performance are at its best; whereas used at a temperature below 32°F (0°C), its battery range and performance may decrease. Typically, the battery range is affected by the temperature. The low temperature will reduce the battery range.
  •  Only use the charger specified by the manufacturer. DO NOT use a charger from any other product.
  • DO NOT charge if the charge port or charge cable is wet.
  • DO NOT charge or use your battery if it is damaged or see a trace of water. Close the charge port cover when not charging.
  • DO NOT attempt to charge your KickScooter if the charger or the power outlet is wet.
  • DO NOT charge outdoors.

Legal Statement

IMPORTANT: The user shall agree to read the entire Important Information and the User Manual and fully understand their contents (especially the parts related to warnings and caution statements) and adhere to the instructions herein before riding this KickScooter.

  1. This KickScooter can be dangerous to a user, other persons, and property in proximity to that. The user shall assume all the risks and losses in connection with the product (especially for those related to and/or arising out of violation of the instructions about warnings and caution statements). Such risks include but not limited to loss of control, failure of the product, and/or collusion) The consequences for such an incident can be severe, including but not limited to injuries, bodily injuries, death, and/or damages to property. Segway shall not be liable for any claim, liability, and loss related to such consequences if it is due to the user’s assumption of risk.
  2. The user may not have necessary and sufficient experience and skills to ride the KickScooter, especially in complex environments and/or undesirable road and/or traffic conditions. Such risk may increase if the user has physical and/or mental impairment or disability, or a user is under the influence of alcohol, drugs or similar substance. Such risk may also increase if the user is not sufficiently familiar with the functions, features and performance of the KickScooter. Thus, the user, especially new users, shall learn and practice how to ride this KickScooter properly and safely. The experience accumulated by practice would normally enable a user to better ride and operate the KickScooter by time.
  3. The parts and components of the KickScooter are subject to fatigue, wear and tear ( “Wear and Tear” ). Many factors, such as environment, aging road conditions and/or riding behaviors may affect the rate of Wear and Tear. Wear and Tear may cause unanticipated and/or sudden failure of the KickScooter, which may cause, inter alia, severe bodily injury or even death. So, the user shall regularly and periodically, as the circumstance requires, inspect and maintain the KickScooter. The user shall also conduct a reasonable examination and inspection of the KickScooter every time before riding it. For instance, every time before riding the KickScooter, the user shall check and examine tire performance, battery level, and all functional parts. If abnormality, discoloration or change of color of material (especially in an area that receives high stress when the KickScooter is in motion or junction), scratch, crack, loose fasteners, and/or missing parts (such as screw, bolts and/or nut) which strongly indicates that it is not safe to ride the KickScooter.
  4. ince it is impossible to predict and/or anticipate all and every scenario, condition, and/or circumstance under which a KickScooter user may be exposed to risk and danger, the Important Information and the User Manual are not intended to be an exhaustive list on how to ride the KickScooter safely and/or avoid hazards related to the KickScooter. In addition, to adhere to the instructions, the user shall also ride and/or use the KickScooter with responsibility, carefulness, precaution, and best judgment. The user should always be a responsible rider, cautious, maintain proper speed and avoid all dangerous riding behaviors, as well as traffic and/or road conditions when riding the KickScooter. For instance, you shall avoid speeding, overloading or performing stunts of any kind. Do not try to touch the tires with your hands or feet while riding. The KickScooter is for one rider only.
  5. The user shall check and obey the local laws or regulations over the KickScooter. It is the sole user’s responsibility that he/she shall ride, use and/or dispose of the KickScooter in compliance with the law. The law and regulations may be different in different jurisdictions. Apart from the others, such laws and regulation may include:
  6. A helmet may be legally required by local law or regulation in your jurisdiction.
  7. Vehicle registration and a license plate may be legally required by local law or regulation in your area.
  8. Your KickScooter may not be allowed to be driven in motorways or highway.
  9. The users shall immediately check whether the KickScooter and its accessories are in good condition upon receipt of the KickScooter.
  10. All the separate components and parts of the KickScooter must be properly installed per the User Manual and the Important Information. Inappropriate installation and/or assembly may significantly increase the risk of loss of control, product failure, collisions, and falls. The KickScooter may contain removable components and small parts. Please keep them out of the reach of children to avoid choking hazards.
  11. Do not dispose of this KickScooter in a landfill, by incineration, or by mixing with household trash. Serious danger/ injury can occur because of the electrical components and the battery. For information about battery and electrical waste, please contact your household waste disposal service, your local or regional waste management office, or your point-of-sale. The user shall not use any non-original accessories or dismantle or modify the KickScooter without authorization. All damages, injuries, and damages to property arising from that place will be your sole responsibility and risk.
  12. Segway reserves the right to make changes to the KickScooter, release firmware updates, and update this manual at any time. Segway may make improvements and changes to the User Manual or the Important Information necessitated by typographical errors, inaccuracies of current information, or modifications to programs and/or equipment at any time and without notice. Such changes will, however, be incorporated into new editions of this Important Information. All illustrations are for illustration purposes only and may not accurately depict the actual device. Actual KickScooter and functions may vary. Due to the update of the KickScooter, there may be some deviations in color, appearance, and other aspects between the KickScooter listed in this Important Information and the KickScooter you purchased. Please refer to the actual KickScooter.
  13. This document should be considered as a permanent part of the KickScooter, and it shall be provided to the user together with the KickScooter all the time.

Limited Warranty of Ninebot KickScooter and Dispute Resolution Agreement
This is a limited warranty provided by the manufacturer of the Ninebot KickScooter (the “Product”) to the consumer or End Users (the “Limited Warranty”). This Limited Warranty only and exclusively applies to the Product distributed and/or sold by and/or through Segway Parties or Segway Dealers in the APAC market, if you are not a resident in the APAC market, please contact us before use of the Product as you may not have warranty or have different warranty than the one provided herein.
THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM YOUR REGION. THIS LIMITED WARRANTY IS A BINDING LEGAL AGREEMENT BETWEEN YOU AND SEGWAY AND OTHER SEGWAY PARTIES. AND IT IS YOUR RESPONSIBILITY TO READ THIS ENTIRE LIMITED WARRANTY AND UNDERSTAND IT BEFORE USE OF THE PRODUCT.

Limited Warranty Period

This Limited Warranty covers only defects of any material or workmanship of the Product and components thereof when the Product and components thereof are being used under normal and ordinary conditions. In an event that a defect covered by this Limited Warranty occurs, Segway authorized distributors, or Parties, or dealers or in its sole discretion will repair or replace the defective Product or components thereof following this Limited Warranty. The applicable Limited Warranty Period for the Limited Warranty commences on the date of the original purchase of the Product from Segway’s authorized reseller, Segway’s authorized distributor, or an authorized Dealer (each a “Segway Dealer” or collectively the Segway Dealers”).

Limited Warranty Service Process

  1. Your service request must be received by Segway within the Limited Warranty Period as described above, and Segway’s authorized reseller, Segway’s authorized distributor, or an authorized Dealer must receive your Product in accordance with the Limited Warranty Service Process defined above, But only if you purchased from a legally authorized reseller, or dealer, or distributor, or parties.
  2. Your Product must be purchased from a Segway authorized reseller, or dealer, or distributor or party. If not, you won’t be able to enjoy the warranty rights of the genuine article, and you won’t be able to receive the protection of the legal framework.
  3. You must provide the original purchase receipt.
  4. Your Product must have the serial number legible, unobscured, unstamped, and unmodified.
  5. All tamper-resistant seals must be intact, in place, and unmodified.

Limited Warranty Exclusions

This Limited Warranty describes the service available to you in the event your Product requires warranty service and you may have additional protections under your local laws. This Limited Warranty does not cover and excludes damage to your Product or any component thereof caused by: 4.1. Abuse, misuse, recklessness, negligence, or commercial use.

  1. Improper charging, storage, maintenance, or operation of the Product not in compliance with instructions or limitations as provided in the user materials.
  2. Use of the Product not in compliance with applicable laws and regulations.
  3. Use of the Product by persons with inadequate experience.
  4. Accident, collision, riding at unsafe speed on paved roads, riding at unsafe speed on unpaved roads, riding over obstacles, amateur racing, professional racing, use in backcountry sports, fire damage, water damage, chemical damage, use of the product outside of the product’s working temperature range, high-pressure water spray, earthquake, dropping, loading with excessive weights.
  5. Modifications to mechanical parts, modification of electronic parts, or modifications to software embedded in the Product.
  6. Service, repair, and maintenance by unauthorized providers.
  7. Cosmetic damages.
  8. Use of the Product with third party product, component, or accessory.
  9. The normal deterioration of wear and tear parts.
  10. Use of the Product with overdue wear and tear parts.

LIABILITY DISCLAIMER AND LIMITATION

SEGWAY AND OTHER SEGWAY PARTIES DO NOT ASSUME, OR AUTHORIZE ANYONE TO ASSUME ON ITS BEHALF, ANY OTHER OBLIGATION OR LIABILITY IN CONNECTION WITH A PRODUCT, ITS COMPONENT PARTS, ACCESSORIES, SERVICE REPAIR, OR THIS LIMITED WARRANTY. SEGWAY AND OTHER SEGWAY PARTIES ARE NOT RESPONSIBLE FOR ANY LOSS OF USE OF A PRODUCT, ITS COMPONENT PARTS, ACCESSORIES, OR FOR ANY INCONVENIENCE OR OTHER LOSS OR DAMAGE WHICH MIGHT BE CAUSED FROM ANY DEFECT IN A PRODUCT, ITS COMPONENT PARTS, ACCESSORIES, SERVICE REPAIR, OR FOR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES THE PURCHASER MAY HAVE AS A RESULT OF ANY DEFECT IN A PRODUCT, ITS COMPONENT PARTS, ACCESSORIES, OR SERVICE REPAIR. SEGWAY AND OTHER SEGWAY PARTIES LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WHETHER ARISING BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE, TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY. THE FOREGOING LIMITATOIN OR EXCLUSIONS OF WARRANTY SHALL SUBJECT TO ANY MANDATORY LAW THAT PROHIBITS SUCH EXCLUSION, LIMITATION, RESTRICTION OR MODIFICATION OF WARRANTY. FOR ANY WARRANTY THAT MAY APPLY HEREIN ON THE GROUND THAT SUCH WARRANTY IS MANDATED BY LAW AND CANNOT BE EFFECTIVELY EXCLUDED, RESTRICTED OR MODIFIED BY THE FOREGOING DISCLAIMER, THE DURATION OF ITS APPLICABILITY SHALL BE THE PERIOD PROVIDED BY THE LIMITED WARRANTY HEREIN OR THAT REQUIRED BY THE APPLICABLE COUNTRY/STATE LAW, WHICHEVER IS SHORTER. SOME COUNTRIES/STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

IN NO EVENT SEGWAY OR OTHER SEGWAY PARTIES’ TOTAL AND AGGREGATE LIABILITY FOR ALL CLAIMS UNDER ANY AND ALL APPLICABLE LAW OR THEORY, JOINTLY OR SEVERALLY, ARISING OUT OF OR RELATED TO THE PURCHASE OF THE PRODUCT, BREACH OF CONTRACT, TORT
(INCLUDING NEGLIGENCE) OR OTHERWISE EXCEEDS THE DUTY TO REPAIR OR REPLACE ANY DEFECTIVE PRODUCT, FURTHER SUBJECT TO SEGWAY’S SOLE AND EXCLUSIVE DISCRETION. IN NO EVENT SHALL BE SEGWAY OR OTHER SEGWAY PARTIES BE LIABLE TO ANY PERSON FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED .

DAMAGED ARISING OUT OF, OR RELATING TO, AND/OR IN CONNECTION WITH THE PURCHASE OF THE PRODUCT, ANY BREACH OF THIS AGREEMENT OR MANUFACTURER’S DUTIES REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT SEGWAY OR OTHER SEGWAY PARTIES WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED, UNLESS SUCH LIMITATIONS AND EXCLUSIONS ARE PROHIBITED BY APPLICABLE LAW. THE FOREGOING LIMITATIONS OR EXCLUSIONS APPLY EVEN IF AN AGGRIEVED CUSTOMER OR ANY OTHER PERSON’S (WHO MIGHT HAVE RIGHT OR CLAIM UNDER THIS AGREEMENT BY OPERATION OF LAW OR EQUITY) REMEDIES UNDER THIS AGREEMENT FAIL OF THEIR ESSENTIAL PURPOSE. IN THE EVENT SOME COUNTRIES/STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN OR ALL OF THE FOREGOING DAMAGES, SO TO THE EXTENT THAT SUCH LIMITATIONS OR EXCLUSIONS ARE NOT ALLOWED BY LAW, THEY MAY NOT APPLY TO YOU. SOME COUNTRIES/STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, SEGWAY PARTIES HEREBY DISCLAIM ANY LIABILITY AND THEREBY SHALL NOT BE RESPONSIBLE FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED DEATH, BODILY INJURY OR DAMAGES TO PROPERTY, ARISING OUT OF OR RELATED TO ANY CONDUCT (INCLUDING MISCONDUCT), ACTION, INACTION, ACT (INCLUDING FAILURE TO ACT), OMISSION OR NEGLIGENCE BY ANY AUTHORIZED OR UNAUTHORIZED DEALER, DISTRIBUTOR, WHOLESALER, RETAILER OR THIRD PARTY THAT INVOLVES INTO DISTRIBUTION OF PRODUCT OR THE SERVICES THERETO. TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE EXPLICIT REPRESENTATIONS, AND WARRANTIES, IF ANY, PROVIDED HEREIN, SHALL BE THE ONLY WARRANTIES AND REPRESENTATIONS MADE BY SEGWAY PARTIES TO ANY CONSUMER OR END USER. SEGWAY PARTIES SHALL NOT BE RESPONSIBLE FOR ANY OTHER WARRANTIES AND/OR REPRESENTATIONS THAT MAY BE GIVEN AND/OR PROVIDED BY ANOTHER PERSON, UNLESS SEGWAY PARTIES HAVE IN A WRITTEN FORM EXPLICITLY AUTHORIZED SUCH ADDITIONAL WARRANTY AND/OR REPRESENTATION TO BE GIVEN TO CONSUMER OR END USER.

Claims and Dispute Resolution

THIE CLAUSE CONTAINED HEREIN ARE LEGALLY BINDING BETWEEN YOU AND SEGWAY, ITS AFFILIATES, THE PRODUCT’S MANUFACTURER, DISTRIBUTORS, SELLERS, AND DESIGNERS AND INCLUDING BUT NOT LIMITED TO EACH OF THOSE SPECIFICALLY NAMES AND NOT SPECIFICALLY NAMED ENTITIES’ PREDECESSOR COMPANIES, SUBSEQUENT COMPANIES, AFFILIATED COMPANIES, SUBSIDIARIES, PARENT COMPANIES, ADMINISTRATORS, SUCCESSORS, ASSIGNS, EMPLOYEES, AGENTS, ATTORNEYS, OFFICERS, DIRECTORS, MANAGERS, MEMBERS, AND REPRESENTATIVES, AND ANY INSURER OR REINSURER THEREOF (TOGETHER “SEGWAY PARTIES”). THE CLAUSE CONTAINED HEREIN MAY AFFECT YOUR RIGHTS TO REMEDY AND IT IS YOUR RESPONSIBILITY TO READ THE FOLLOWING SECTIONS CAREFULLY BEFORE USE OF THE PRODUCT.

Binding Arbitration
Segway Parties and you agree that any dispute, controversy or claim arising out of, relating to or in connection with this agreement, the limited warranty, the sale, condition or performance of the product, whether based in contract, tort, fraud, misrepresentation, or any other legal theory at law or in equity, including but not limited to any claims for death, injury or property damages, shall be submitted to binding arbitration upon the request of either party upon the service of that request on the other party. This arbitration clause shall apply all the persons in privity with you, including your family members, beneficiaries, and assigns.
The arbitration shall be conducted by China International Economic and Trade Arbitration Commission (CIETAC) in accordance with its rules of in effect at the time of applying for arbitration. The place of arbitration shall be Beijing. Segway Parties and you further acknowledge and confirm that the arbitral award shall be final and binding upon all Parties, not subject to any appeal; and shall deal with the question of costs of arbitration and all matters related thereto. Enforcement of the award rendered by the arbitrators may be entered into by any court having jurisdiction thereof. Segway Parties and you agree that this Agreement will be governed by and construed, interpreted, and enforced in accordance with the laws of the People’s Republic of China with the Hong Kong Special Administrative Region, Macau Special Administrative Region, and Taiwan being excluded.

YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS ARISING FROM OR RELATING TO ANY AND ALL CLAIMS AND DISPUTES WITH SEGWAY PARTIES. YOU AGREE TO ARBITRATE SOLELY ON AN INDIVIDUAL BASIS, AND THAT THIS AGREEMENT DOES NOT PERMIT CLASS ARBITRATION OR ANY CLAIMS BROUGHT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ARBITRATION PROCEEDING. THE ARBITRAL TRIBUNAL MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. IN THE EVENT THE PROHIBITION ON CLASS ARBITRATION IS DEEMED INVALID OR UNENFORCEABLE, THEN THE REMAINING PORTIONS OF THE ARBITRATION AGREEMENT WILL REMAIN IN FORCE.
Section 6 “Claims and Dispute Resolution” clause shall survive upon termination or expiration of this agreement and/or limited warranty or in an event that this agreement and/or the limited warranty is held as void, avoidable, invalid, or unenforceable, either in whole or part, by a competent adjudication institution with actual authority and jurisdiction over this matter.

Opt-Out
YOU MAY OPT OUT OF THIS DISPUTE RESOLUTION PROCEDURE BY PROVIDING NOTICE TO SEGWAY AND OTHER SEGWAY PARTIES NO LATER THAN THIRTY (30) CALENDAR DAYS AFTER THE DATE OF THE FIRST CONSUMER PURCHASER’S PURCHASE OF THE PRODUCT. Limited Warranty
This Limited Warranty by Segway covers only defect(s) in material or workmanship of the Product under normal use that may exist at the time when it is sold by Segway, and the Limited Warranty by Segway shall not apply to any defect, defective condition and/or damages to the Product that is caused by another person or you after it is sold by Segway. The Limited Warranty does not apply to normal wear and tear and/or deterioration associated with use of the Product. In the event that a defect covered by this Limited Warranty occurs, Segway and/or other Segway Parties (as applicable) in its sole discretion will repair or replace defective Product in accordance with this Limited Warranty. The applicable Limited Warranty Period commences on the first date that a new Product is purchased from an authorized retailer of the Product. This warranty gives you specific legal rights, and if you are a consumer in the United States of America, you may also have other rights which vary from State to State.

THIS LIMITED WARRANTY HEREIN IS THE ONLY EXPRESS WARRANTY APPLICABLE TO PRODUCT AND ITS COMPONENT PARTS, ACCESSORIES, AND SERVICE REPAIR. SEGWAY AND SEGWAY PARTIES DISCLAIM ALL OTHER EXPRESS WARRANTIES. Limited Warranty Eligibility

  1. Your service request must be received by Segway within the Limited Warranty Period as described above, and the authorized service provider assigned by Segway for the services must receive your Product for warranty services purpose within the Limited Warranty Period and in accordance with the Limited Warranty Service Process defined above.
  2. Your Product must be purchased from a Segway Dealer.
  3. You must provide the original purchase receipt.
  4. Your Product must have the serial number clearly legible, unobscured, untampered and unmodified.
  5. All tamper-resistant seals must be intact, in place and unmodified.
  6. If the Product is NOT serviced and/or repaired by an authorized service provider, and/or if aftermarket, unauthorized or recycled part is used to repair the Product, this will not void the Limited Warranty. However, Segway and the Limited Warranty shall not be responsible for any Product failure, defect and/or damages to the other part of the Product that is caused by such unauthorized services and/or repair, and/or use of such aftermarket or recycled parts.
  7. The Limited Warranty is VOID, if the Product is used in the following activities: racing, competition or rental.

Limited Warranty Exclusions
This Limited Warranty does not cover and excludes damage to, defect in and/or failure of your Product or any component thereof caused by:

  1. Abuse, misuse, recklessness, negligence, or commercial use.
  2. Improper charging, storage, maintenance, and/or operation of the Product.
  3. Use of the Product not in compliance with applicable laws and regulations.
  4. Accident, collision, riding at an unsafe speed and/or road conditions and/or environment
  5. fire damage, water damage, chemical damage, damages caused by outside forces, use of the Product outside of the Product’ s working temperature range, high-pressure water spray, earthquake, dropping, loading with excessive weights.
  6. Modifications of Products including mechanical parts, electronic parts, and/or software embedded in the Product that is not explicitly and clearly authorized by Segway in writing.
  7. Subject to section 3.6, improper service, repair, installation, and maintenance by person(s) that is not an authorized service provider of the Product.
  8. Subject to section 3.6, use of non-genuine Segway parts or parts not authorized by Segway, incorporation or use of unsuitable attachments or parts.
  9. Cosmetic damages.
  10. Normal deterioration associated with use of the Product, wear and tear.
  11. Shipment of the Product to an authorized service provider or service center for service.
  12. Vandalism, theft, crime.
  13. Natural disaster, act of nature.

DISCLAIMER AND LIMITATION OF LIABILITY

  1. SEGWAY AND OTHER SEGWAY PARTIES DO NOT ASSUME, OR AUTHORIZE ANYONE TO ASSUME ON ITS BEHALF, ANY OTHER OBLIGATION OR LIABILITY IN CONNECTION WITH A PRODUCT, ITS COMPONENT PARTS, ACCESSORIES, SERVICES, REPAIR, OR THIS LIMITED WARRANTY.
  2. SEGWAY AND OTHER SEGWAY PARTIES ARE NOT RESPONSIBLE FOR ANY LOSS OF USE OF A PRODUCT, ITS COMPONENT PARTS, ACCESSORIES, OR FOR ANY INCONVENIENCE OR OTHER LOSS OR DAMAGE WHICH MIGHT BE CAUSED FROM ANY DEFECT IN A PRODUCT, ITS COMPONENT PARTS, ACCESSORIES, SERVICE REPAIR, OR FOR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES THE PURCHASER MAY HAVE AS A RESULT OF ANY DEFECT IN A PRODUCT, ITS COMPONENT PARTS, ACCESSORIES, OR SERVICE REPAIR. SOME COUNTRIES/STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU

IN NO EVENT SEGWAY OR OTHER SEGWAY PARTIES’ TOTAL AND AGGREGATE LIABILITY FOR ALL CLAIMS UNDER ANY AND ALL APPLICABLE LAW OR THEORY, JOINTLY OR SEVERALLY, ARISING OUT OF OR RELATED TO THE PURCHASE OF THE PRODUCT, BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHEWISE EXCEEDS THE DUTY TO REPAIR OR REPLACE ANY DEFECTIVE PRODUCT, FURTHER SUBJECT TO SEGWAY’S SOLE AND EXCLUSIVE DISCRETION. IN NO EVENT SHALL BE SEGWAY OR OTHER SEGWAY PARTIES BE LIABLE TO ANY PERSON FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES ARISING OUT OF, OR RELATING TO, AND/OR IN CONNECTION WITH THE PURCHASE OF THE PRODUCT, ANY BREACH OF THIS AGREEMENT OR MANUFACTURER’S DUTIES REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT SEGWAY OR OTHER SEGWAY PARTIES WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED, UNLESS SUCH LIMITATIONS AND EXCLUSIONS ARE PROHIBITED BY APPLICABLE LAW. THE FOREGOING LIMITATIONS OR EXCLUSIONS APPLY EVEN IF AN AGGRIEVED CUSTOMER OR ANY OTHER PERSON’S (WHO MIGHT HAVE RIGHT OR CLAIM UNDER THIS AGREEMENT BY OPERATION OF LAW OR EQUITY) REMEDIES UNDER THIS AGREEMENT FAIL OF THEIR ESSENTIAL PURPOSE. IN THE EVENT SOME COUNTRIES/STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN OR ALL OF THE FOREGOING DAMAGES, SO TO THE EXTENT THAT SUCH LIMITATIONS OR EXCLUSIONS ARE NOT ALLOWED BY LAW, THEY MAY NOT APPLY TO YOU. SOME COUNTRIES/STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

To the extent permitted by applicable law, SEGWAY PARTIES hereby DISCLAIM any liability and thereby shall not be responsible for any damages, including but not limited death, bodily injury or damages to property, arising out of or related to any conduct (including misconduct), action, inaction, act (including failure to act), omission or negligence by any authorized or unauthorized dealer, distributor, wholesaler, retailer or third party that involves into the distribution of Product or the services thereto. To the extent permitted by applicable law, the explicit representations and warranties, if any, provided herein, shall be the only warranties and representations made by SEGWAY PARTIES to any consumer or end user. SEGWAY PARTIES shall not be responsible for any other warranties and/or representations that may be given and/or provided by another person, unless Segway Parties have in a written form explicitly authorized such additional warranty and/or representation to be given to consumer or end user.
  5. If you are a New Jersey consumer, sections 5.2–5.4 shall not apply to you. FOR NEW JERSEY CONSUMERS, TO THE EXTENT PERMITTED BY NEW JERSEY LAW, SEGWAY PARTIES AND SEGWAY DEALERS ARE NOT RESPONSIBLE FOR ANY LOSS OF USE OF A PRODUCT, ITS COMPONENT PARTS, OR ACCESSORIES, OR FOR ANY INCONVENIENCE OR OTHER LOSS OR DAMAGE WHICH MIGHT BE CAUSED FROM ANY DEFECT IN A PRODUCT, ITS COMPONENT PARTS, ACCESSORIES, SERVICE REPAIR, OR FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGED, YOU MAY HAVE AS A RESULT OF ANY DEFECT IN A PRODUCT, ITS COMPONENT PARTS, ACCESSORIES, OR SERVICE REPAIR.

Claims, Dispute Resolution and Mandatory Arbitration
THE CLAUSES CONTAINED HEREIN ARE LEGALLY BINDING BETWEEN YOU AND SEGWAY PARTIES AND SEGWAY DEALERS. THE CLAUSES CONTAINED HEREIN MAY AFFECT YOUR RIGHTS, AND IT IS YOUR RESPONSIBILITY TO READ THE FOLLOWING SECTIONS. YOU CAN OPT-OUT OF THE AGREEMENT WITHIN 30 CALENDAR DAYS OF THE FIRST CONSUMER PURCHASE BY EMAILING OPTOUT@SEGWAY.COM AND PROVIDING THE APPLICABLE INFORMATION. FOR MORE DETAILS, PLEASE SEE SECTION 6.3.

Binding Arbitration
Segway Parties and you agree that any dispute, controversy or claim arising out of, relating to or in connection with this agreement, the limited warranty, the sale, condition or performance of the product, whether based in contract, tort, fraud, misrepresentation or any other legal theory at law or in equity, including but not limited to any claims for death, injury or property damages, shall be submitted to binding arbitration upon the request of either party upon the service of that request on the other party. This arbitration clause shall apply all the persons in privity with you, including your family members, beneficiaries and assigns. The arbitration shall be conducted by the American Arbitration Association (AAA) pursuant to its Commercial Arbitration Rules and the Supplementary Procedures for Consumer- Related Disputes (collectively “AAA Rules”). The AAA Rules are available online at adr.org, or by calling the AAA at 1-800-778-7879. The arbitration shall be conducted before a single arbitrator, whose award may not exceed, in form or amount, the relief allowed by the “Liability Disclaimer and Limitation” clause herein subject to the applicable law. The arbitration tribunal shall have the power to rule on any challenge to its own jurisdiction or to the validity or enforceability of any portion of the agreement to arbitrate. Any decision of the arbitrator shall be final and may be entered into any judgment in any court of competent jurisdiction. You waive the right to have your claim heard in a court of law and by jury. You waive the right to participate in class actions arising from or relating to any and all claims and disputes with Segway Parties. You agree to arbitrate solely on an individual basis, and that this agreement does not permit class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding. The arbitral tribunal may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. In the event the prohibition on class arbitration is deemed invalid or unenforceable, then the remaining portions of the arbitration agreement will remain in force. Section 6 “Claims and Dispute Resolution” clause shall survive upon termination or expiration of this agreement and/or limited warranty or in an event that this agreement and/or limited warranty is held as void, avoidable, invalid or unenforceable, either in whole or part, by a competent adjudication institution with actual authority and jurisdiction over this matter. Segway Parties require and you hereby agree that you shall arbitrate your claims against Segway Parties pursuant to the arbitration described above prior to your exercise of your rights pursuant to title of the Magnuson-Moss Warranty Act. Title i of the Magnuson-Moss Warranty Act does not require you to pursue rights and remedies available to you that are not provided by title i of the Magnuson-Moss Warranty Act.

Small Claim
For any arbitration in which your total claims, exclusive of attorney fees and expert witness fees, is $5,000.00 or less (“Small Claim”), the arbitrator may, if you prevail, award your reasonable attorney fees, expert witness fees and costs as part of any award on the condition of the arbitrator’s actual and affrmative finding that the claim is non-frivolous. In a Small Claim case, you are required to pay no more than half of the total administrative, facility and arbitrator fees, or $50.00 of such fees, whichever is less, and Segway Parties shall pay the remainder of such fees. In a Small Claim case, Segway Parties shall not recover any attorney fees provided that your claim is non- frivolous. Administrative, facility and arbitrator fees for arbitrations in which your total claimed damages, exclusive of attorney fees and expert witness fees, exceed $5,000.00 (“Large Claim”), shall be determined according to AAA Rules. In a Large Claim case, the arbitrator may grant to the prevailing party, or apportion among the parties, reasonable attorney fees, expert witness fees and costs. The arbitrator shall be entitled to award declaratory or injunctive relief upon request by any party.

Federal Arbitration Act
The Federal Arbitration Act governs this arbitration clause. This agreement evidences a transaction in interstate commerce, and thus the Federal Arbitration Act governs its interpretation and enforcement.

Procedure
The following is a description of the arbitration process

  • A. Mail a Notice of Dispute to Ninebot and/or the other relevant Ninebot Parties. Prior to initiating arbitration against Ninebot Parties, you must first notify Ninebot and/or the other relevant Ninebot Parties of your dispute in good faith. Please include your contact information, your concerns, and the relief you intend to seek from Ninebot Parties, and any information you believe would be helpful in resolving the dispute. Ninebot and/or the other relevant Ninebot Parties will review your Notice of Dispute to determine whether Ninebot Parties may settle it with you to avoid arbitration. The notice should be sent by certified mail to Attention: Disputes, Segway Inc., 14 Technology Drive, Bedford, NH 03110. Please keep a copy of your notice for your records.
  • B. Wait 30 Days. Ninebot Parties will review your Notice of Dispute within thirty (30) days of Ninebot’s receipt of your Notice of Dispute. If you do not hear from Ninebot within thirty (30) days of its receipt of your Notice of Dispute, you may proceed with filing an arbitration claim against Ninebot Parties. Should Ninebot provide you a written settlement offer, please keep this settlement offer because Ninebot Parties and you will be required to show this settlement offer to the arbitrator. Notwithstanding the foregoing, such offer, if any, shall not be shown to the arbitrator until after the arbitrator’s determination on the merits of your claim.
  • C. Complete a Demand for Arbitration. You can initiate arbitration by completing a Demand for Arbitration that includes a basic statement of the (i) names and addresses and telephone numbers of the parties involved; (ii) your description of the dispute; and (iii) your short statement detailing why you are entitled to relief.
  • D. Send Ninebot Parties Your Demand for Arbitration. You can send Ninebot and/or the other relevant Ninebot Parties your Demand for Arbitration at the following address: Attention: Disputes, Segway Inc., 14 Technology Drive, Bedford, NH 03110. Please keep a copy of your notice for your record.
  • E. Send AAA Two (2) Copies of Your Demand for Arbitration. The Demand for Arbitration includes the address that you are to send two (2) copies of your Demand for Arbitration. This address is AAA Case Filing Services at 1101 Laurel Oak Road, Suite 100, Voorhees, NJ 08043. You should also include a copy of this warranty policy, and the appropriate filing fee. Ninebot Parties will reimburse you for this filing fee. If you cannot afford to pay the filing fee, please contact Ninebot, and Ninebot will pay the filing fee for you if your claims seek a remedy less than $75,000. AAA has an online filing option that you can find on its website: www.adr.org.
  • F. AAA Appointment of Arbitrator. If no claim in the arbitration exceeds $75,000, the AAA will appoint an arbitrator and notify you and Ninebot Parties of the arbitrator’s name and qualification. The AAA requires all arbitrators to check for any past or present relationships with the parties, potential witnesses, and the parties’ attorneys. If the arbitrator has any such relationship, the AAA will inform Ninebot Parties and you. If either you or Ninebot Parties object to the AAA’s choice of arbitrator, we’ll have seven (7) days to inform the AAA.
  • G. Choose the Type of Hearing You Would Like. Unless you and Ninebot Parties agree to have any arbitration hearings somewhere else, the arbitration will take place in the county (or parish) that you purchased the Product. If your claim is for $10,000 or less, you may choose to have the hearing conducted by telephone or in person. Alternatively, you may choose to proceed to conduct the entire arbitration through written correspondence with the arbitrator that doesn’t include an interactive hearing. Once the AAA has commenced the arbitration, you have ten (10) days to inform the AAA of your choice of hearing. If you don’t make a choice, the AAA will conduct the arbitration by written correspondence without an interactive hearing. If your claim exceeds $10,000, the right to a hearing will be determined by the AAA rules. Those rules currently provide for an in-person hearing if your claim exceeds $10,000, but you and Ninebot Parties may agree whether that hearing is in person or by telephone, or whether to instead proceed with written correspondence.
  • H. Arbitrator’s Decision. Within fourteen (14) days from the conclusion of the in-person or telephone hearing, or from the submission of all written evidence to the arbitrator if you have elected to conduct the arbitration through written correspondence, the arbitrator will render a written decision. That decision will include the essential findings and conclusions upon which the arbitrator based his or her award. Ninebot Parties will immediately respond to the arbitrator notifying the arbitrator whether, and to what extent, Ninebot Parties will abide by the decision, perform the obligations it has agreed to do. Any decision by the arbitrator may be utilized by any party for any reason.
  • I. The parties agree to keep strictly confidential any conduct, communication, and information disclosed and/or communicated to the other party under Section 6 (Claims, Dispute Resolution and Mandatory arbitration), including but not limited to the existence of dispute resolution, mediation (if the parties agree to conduct mediation), settlement, arbitration, arbitral proceedings, submissions made by the parties and the decisions made by arbitral tribunal, including its awards to the extent not already in the public domain, except in judicial proceedings related to the award or whererequired by applicable law.

Statute of Limitation
The parties agree that any direct or indirect dispute, controversy, or claim arising out of, related to, or in connection with this Agreement, the Limited Warranty, the sale, condition, or performance of the Product, whether based in contract, tort, fraud, misrepresentation or any other legal theory at law or in equity, including but not limited to any claims for death, injury or property damages, must be commenced within one year after the cause of action has occurred.

Severability

If any term, clause, or provision of this Agreement is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term, clause or provision of this Agreement or invalidate or render unenforceable such term, clause or provision in any other jurisdiction. Upon a determination that any term, clause, or provision is invalid, illegal, or unenforceable, the parties shall negotiate in good faith, and if negotiation fails, the arbitral tribunal may modify this Agreement to give effect to the original intent of the parties as closely as possible in order that the transactions contemplated hereby be consummated as originally contemplated to the greatest extent possible.
