To Whom It May Concern:

Regarding U.S. Environmental Protection Agency (EPA) exempted pesticides, the EPA allows for certain pesticides to be exempt from federal registration under the Federal Insecticide Fungicide and Rodenticide Act (FIFRA) provided that the pesticide meets 6 conditions. Those 6 conditions are described in 40 CFR 152.25(f) and state:

1. The product’s active ingredients must only be those that are listed in 40 CFR 152.25(f)(1).
2. The product’s inert ingredients may only be those that have been classified by EPA as:
3. Listed in 40 CFR 152.25(f)(2)
4. commonly consumed food commodities, animal feed items, and edible fats and oils as describedin 40 CFR 180.950(a), (b), and (c); and
5. certain chemical substances listed under 40 CFR 180.950(e).
6.  All of the ingredients (both active and inert) must be listed on the label. The active ingredient(s) must belisted by label display name and percentage by weight. Each inert ingredient must be listed by label display name.
7. The product must not bear claims either to control or mitigate organisms that pose a threat to humanhealth, or insects or rodents carrying specific diseases.
8. The name of the producer or the company for whom the product was produced and thevb company’sb contact information must be displayed prominently on the product label.
9. The label cannot include any false or misleading statements.

The products listed below (often referred to as “minimum risk pesticides” or “25(b) products”) were reviewed by S.C. Johnson & Son Inc.’s North America Registration and Regulatory Compliance Department and by state regulators. They were found to meet the conditions above and therefore qualify as exempt from federal registration under FIFRA. In addition, according to Sections 6145-6168 of the California Code of Regulations, these products qualify for an exemption from registration by the California Department of Pesticide Regulation (CDPR).

Regarding pesticide devices, FIFRA does not require devices to undergo premarket review and EPA registration before being sold and distributed. Pesticide device requirements are described in 40 CFR 152.500.

The products listed below were reviewed by S.C. Johnson & Son Inc.’s North America Registration and Regulatory Compliance Department and by state regulators and were found to qualify as pesticide devices. In
addition, according to California State law [AB 1134, (Chapter 651, Statutes of 1998)], these types of pesticide device products do not require registration by the California Department of Pesticide Regulation (CDPR).
