State Compliances

§ 2600.14. Fire safety approval

FIRE SAFETY APPROVAL

  1. Prior to issuance of a license, [Agency Name] shall obtain a written fire safety approval from the Department of Labor and Industry, the Department of Health, or the appropriate local building authority under the Pennsylvania Construction Code Act (35 P. S. §§ 7210.101—7210.1103).

§ 2600.14a. Fire safety approval—statement of policy

Policy:
[Agency Name] shall comply with the requirements of § 2600.14a of the Pennsylvania Personal Care Homes regulations regarding fire safety approval. The agency shall obtain and maintain a valid Certificate of Occupancy that specifies the use and occupancy classification required by the Pennsylvania Construction Code Act or the previously promulgated Commonwealth fire and panic law and regulation. The agency shall also ensure that the numbers and needs of the residents served in the home comply with the use and occupancy classification of the Certificate of Occupancy.

Procedures:

Obtain and maintain a valid Certificate of Occupancy:

  • [Agency Name] shall obtain a valid Certificate of Occupancy specifying the use and occupancy classification required by either the Pennsylvania Construction Code Act or the previously promulgated Commonwealth fire and panic law and regulation.
  • The agency shall ensure that the Certificate of Occupancy is valid and up-to-date, and that it accurately reflects the use and occupancy classification of the premises.
  • If there are any changes to the use or occupancy classification of the premises, or if the building undergoes renovations or alterations, the agency shall obtain a new Certificate of Occupancy or written certification that a new Certificate of Occupancy is not required.

Comply with the occupancy requirements:

  • If the agency does not have a valid Certificate of Occupancy with the correct use and occupancy classification consistent with the actual use of the premises, it shall provide a plan to the Department within 12 months of the date of the Department’s determination.
  • The plan shall include a revised description of services and the suspension of new admissions of persons with mobility needs until the agency is in compliance with the occupancy requirements.
  • The agency shall follow the plan to come into compliance with the occupancy requirements as soon as possible.

Notify the Department:

  • [Agency Name] shall notify the Department of Labor and Industry, the Department of Health, or the appropriate local building authority if the fire safety approval is withdrawn or restricted.
  • The agency shall provide the notification orally immediately and in writing within 48 hours of the withdrawal or restriction.
