Product Usage Instructions

Alpine Infant Seat Base

  1. Attach the ReboundReduceTM Stability Bar to the base.
  2. Press the Recline Button to adjust the recline angle.
  3. Utilize the ClickTight Locking Point to secure the base in the vehicle.
  4. Check the Recline Angle Indicator to ensure proper positioning.
  5. Locate the Recline Foot under the base for additional adjustment.
  6. Use the Belt Guides to route the vehicle’s seat belt correctly.
  7. Open the ClickTight Compartment Lid.
  8. Hold the ClickTight Handle and pull up to open the ClickTight Indicator Window.
  9. Connect the Lower Connectors to the vehicle’s lower anchors.
  10. Refer to the Serial Number & Manufacture Date Label for important information.
  11. Store the Lower Connectors in the designated Lower Connector Storage.
  12. Keep the Secondary User Guide in the provided storage space.

Willow SC Carrier

  1. To remove the carrier from the base or stroller, release the lever.
  2. Refer to the Serial Number & Manufacture Date Label for important information.
  3. Adjust the Harness Straps and secure them in the Harness Yoke.
  4. Position the Harness Slots and Hip Slots according to your child’s size.
  5. Insert your child into the carrier and align the Buckle Slots with the harness buckle and chest clip.
  6. Attach the Sun Visor for additional sun protection.
  7. Add the Infant Positioning Pillow if needed for extra support.
  8. Use the Harness Adjuster Lever and Strap to tighten or loosen the harness.
  9. Attach the Head Pad Pillow for additional comfort.
  10. Install the carrier without the base using the Baseless Install MBelt Guides.
  11. Store the User Guide in the provided storage space.
  12. Ensure the carrier shell is securely locked into place.
  13. Fasten the Chest Clip and Buckle Strap.
  14. Add Comfort Pads or a Belly Pad if desired.

WARNING

Read all instructions before use of the infant carrier.

  • Failure to follow all warnings and instructions could result in SERIOUS INJUSRY OR DEATH.

  • Use only in a rear-facing position when using it in the vehicle.

  • Use only with children who weigh between 4 and 30 pounds (1.8 and 13.6 kg) and whose height is 32 inches (81.3 cm) or less.

  • Snugly adjust the belts provided with this child restraint around your child.

  • Follow all instructions on this child restraint and in the written instructions located under the seat cover. Keep the instructions with the restraint for future use.

  • Secure this child restraint with the vehicle’s child restraint anchorage system, if available, or with a vehicle belt. Using both methods is not approved and may cause the child seat not to perform as intended.

  • Register your child restraint with the manufacturer.

  • NEVER leave child unattended.

  • Suffocation Hazard: Infant carrier can roll over on soft surfaces and suffocate child. NEVER place carrier on beds, sofas, or other soft surfaces.

  • Fall Hazard: Child’s activity can move carrier. NEVER place carrier on counter tops, tables, or any other elevated surface.

  • A snug strap should not allow any slack. You should not be able to pinch excess.

  • This child seat can only be used in the following classes of vehicles: multi-purpose passenger vehicles, passenger cars, or trucks.

  • In a vehicle with rear designated seating positions, vehicle owners should be alerted that, according to accident statistics, children are safer when properly restrained in the rear seating positions than in the front seating positions. To ensure your child’s safety, please study Vehicle Seating Positions on page 58 and consult your vehicle owner’s manual.

  • The use of non-Britax covers, inserts, toys, accessories, or tightening devices is not approved by Britax. Their use could cause this child seat not to perform as intended in a crash.

  • ALWAYS check the back seat upon leaving your vehicle to prevent leaving a child restrained in the infant car seat alone in the vehicle.

  • Fall Hazard: The carrier can fall from the shopping cart.
    DO NOT use on shopping cart.

  • Fall Hazard: NEVER use this child restraint on boats, low speed vehicles (LSV), all-terrain vehicles (ATV), golf carts, or any other non-certified application.

  • Strangulation Hazard: Children have STRANGLED in loose or partially buckled harness straps. Fully restrain the child even when carrier is used outside the vehicle.

  • ALWAYS lift infant car seat by both sides of carry handle after installation in base to verify that it is secure.

  • DO NOT use the infant carrier if it is damaged or broken.

  • To prevent injury due to deterioration or hidden damage, DO NOT use this infant car seat and base if it is older than six (6) years or has been in a moderate or severe crash. See expiration date on the date of manufacture label located on the infant car seat and base.

  • Always make sure the child restraint system is secured to the vehicle, even when unoccupied, since in a crash an unsecured child restraint system may injure occupants.

  • The primary protection for occupants of a vehicle in a collision is the body of the vehicle itself; a child seat will not protect a child when a vehicle is seriously impacted. However, correctly installed, a child seat will substantially improve chances for survival in most crashes. Make sure all users fully understand the correct ways to use this child seat in a vehicle.

  • Do NOT route belt(s) through ClickTight handle opening for any installation method.

Important Notes

  • Discontinue use of this child seat if it has been in a moderate or severe crash. It is not necessary to replace a car seat after a minor crash defined by the U.S. National Highway Traffic Safety Administration (NHTSA) as:
    • The vehicle is drivable from the crash site; and
    • The vehicle door nearest the child seat was not damaged; and
    • No vehicle occupants were injured; and
    • There is no visible damage to the child seat; and
    • The airbags (if present) did not deploy.
  • Verify that the child restraint and child restraint belts or straps do not interfere with the opening and closing of the vehicle door.
  • Consult vehicle user guide to ensure child restraint installation does not interfere with function of vehicle seats.
  • Ensure the lower harness (waist) straps are firmly adjusted in a position so that the child’s pelvic area is secure.
  • Ensure the upper harness (shoulder) straps are firmly adjusted so that the child is secure.
  • Never leave child unattended.
  • Do not, except as described in this booklet, attempt to disassemble any part of the child seat or change the way the harness or vehicle’s seat belts are used.
  • Do not allow children to play with this child seat.
  • Do not use anything to raise the child seat off vehicle seat except as described in these instructions. In a crash, this could cause the child seat not to perform as intended.
  • Store the infant car seat in a safe, dry place when it will not be used for an extended period of time. Do not place heavy objects on top of it.

Certified for Aircraft Travel

Aircraft – Baseless Installation with Lap Belt (see page 39)

  • Install your child restraint in a window seat to avoid blocking the aisle.
  • If the aircraft lap belt is too short, ask a flight attendant for a belt extender.
  • Your child may experience discomfort if the buckle is located in the seating area of the child restraint after installation.
  • Inflatable aircraft lap belts are not compatible with this child seat.
  • This seat may not fit all aircraft. Contact your airline prior to travel to verify fit.

Child Fit Information

Use rear-facing only with children:

  • who weigh between 4 and 30 lbs (1.8 and 13.6 kg) and
  • who are 32” (81.3 cm) in height or less and
  • when the top of the head is 1” (2.5 cm) or more below the top of the shell and
  • when the harness straps are located in the closest harness slot below the child’s shoulders. IMPORTANT: See Adjusting the Harness on page 46 for additional child fit guidance.

Attaching the ReboundReduceTM Stability Bar

  1. Push the ReboundReduceTM Stability Bar into the receivers on the base until a click is heard.
  2. Pull up on the ReboundReduceTM Stability Bar to verify that it is secure.

NOTE: The ReboundReduceTM Stability Bar cannot be removed once installed.

Using with the Base
Before installing the child restraint:

  • Check that your vehicle seat belt is compatible with the child restraint by referring to your vehicle owner’s manual and page 60 in this user guide.

Overhang
It is important that the base of the child restraint rests completely flat on the vehicle seat with no side overhang. It is permissible to allow up to 4.7” (11.9 cm) of the base to hang over the edge of the vehicle seat.

Adjusting the Recline Angle

IMPORTANT: Vehicle must be parked on a level surface.

  1. Press the recline adjustment button.

  2. Place base on the vehicle seat.

  3. Move the base up or down until the entire blue marker is completely visible between the two lines on the recline angle indicators.
    IMPORTANT: After the child is secured in the child restraint and the child restraint is attached to the base, ensure that the entire blue marker is completely visible between the two lines on the recline angle indicator.
    If there is a problem achieving the proper recline angle after installing, try another approved seating position in your vehicle or:

    • Uninstall the base and lower the recline angle adjustment foot to the lowest position.
    • Remove the base from the vehicle and place a rolled towel or pool noodle in the vehicle seat bight.
    • Place the base against the towel or pool noodle and install.
      NOTE: If a towel or pool noodle is needed for the recline angle, the recline angle adjustment foot on the base should remain in its lowest position.

ClickTight Indicator
The ClickTight indicator window will be ENTIRELY GREEN (a) when the ClickTight is fully open and (b) when it is closed correctly.

  • When ClickTight is fully open, the indicator window will be entirely green.
  • When ClickTight is closed correctly, the indicator window will be entirely green.

Lap-Shoulder Belt Installation

NOTE: Do not lock/switch the vehicle belt retractor. The ClickTight replaces the need for a locked/switched vehicle belt.

  3.  Pull the lap and shoulder belt across the base.
    NOTE: Ensure the vehicle belt is not twisted.

  5. Open the storage compartment lid and remove the lower connectors and lengthen. Close the storage compartment lid.

  6. Tuck the lower connector strap under the ClickTight and belt guides.
    NOTE: Ensure the strap is tucked under the ClickTight completely.
    NOTE: Ensure the connector strap is not blocking the locking point for the ClickTight.

  7. Push the lower connectors onto the vehicle lower anchors until a click is heard.
    NOTE: Pull the lower connectors to verify they are secure.

  8. Pull the adjustment strap to remove slack.
    NOTE: Overtightening the belt may prevent the ClickTight from closing.

  9. Close the ClickTight by pushing down on the ClickTight handle.
    NOTE: Ensure indicator in window is ENTIRELY GREEN.
    NOTE: A click helps confirm the ClickTight is secure.

Base Installation with Lower Connectors

CHECKLIST

  • The base is secure when it moves less than 1” (2.5 cm) front-toback or side-to-side at the vehicle belt path.
  • The entire blue marker is completely visible between the two lines on the recline angle indicators.
  • Lower connector strap is routed under both belt guides and the ClickTight.
  • Lower connector storage compartment lid is closed and secure prior to attaching carrier.

Attaching the Child Restraint to the Base

  1. Ensure that the base is securely installed.
    NOTE: Ensure lower connector storage compartment lid is secure over lower connector storage prior to placing child restraint into the base.

  2. Place the child restraint into the base and press down until a click is heard.

  3. Pull up on both sides of the child restraint to verify attachment.

  4. Ensure that the carry handle is in a locked position and check that the recline angle is still correct.

Removing the Child Restraint from the Base

  1. Pull up and hold the lever on the back of the child restraint.
  2. Lift the child restraint up from the base using the carry handle.
Uninstalling the Base

Lap Shoulder Belt Uninstall

  1. Unbuckle the vehicle belt.
  2. Open the ClickTight.
    • Grab the ClickTight handle and squeeze the button.
    • Lift the ClickTight handle.
  3. Pull the belt from the base belt routes.

Lap Belt Uninstall

  1. Unbuckle the vehicle belt.
  2. Open the ClickTight.
    • Grab the ClickTight handle and squeeze the button.
    • Lift the ClickTight handle.
  3. Pull the belt from the base belt routes.

Lower Connector Uninstall

  1. Loosen the lower connector straps.
  2. Press each of the red release buttons on the lower connectors and release from vehicle anchors.
  3. Open the ClickTight.
    • Grab the ClickTight handle and squeeze the button.
    • Lift the ClickTight handle.
  4. Store the lower connectors in the storage compartment in the base and replace the storage compartment lid.

Using without the Base

Before installing the child restraint

  • Secure the child in the child restraint before installing in the vehicle.
  • Check that your vehicle seat belt is compatible with the child restraint by referring to your vehicle owner’s manual and page 60 in this user guide.
  • Check your vehicle owner’s manual to determine how to lock your vehicle belt system.

  • Place the child restraint against the towel(s) or pool noodle(s) to level the child restraint and install.

Lap-Shoulder Belt Installation with European Belt Guide

IMPORTANT: Check your vehicle owner’s manual to determine how to lock your vehicle belt system.

If you cannot lock your vehicle seat belt you must use a locking clip. Locking clips are available from Britax at 1-888-427-4829 or 1-704-409-1699.

  1. Secure your child in the child restraint before installing in the vehicle. See page 42.

  2. Place the child restraint rear facing on the vehicle seat.

  3. Pull the vehicle belt out and route the lap portion under the child restraint belt guides and buckle.
    NOTE: Verify that the vehicle belt is not twisted.

  4. Wrap the shoulder belt around the child restraint, through the European belt guide. Lock your vehicle seat belt system as instructed by your vehicle owner’s manual.

  5. Push the child restraint firmly into the vehicle seat while removing all slack from the lap portion and then the shoulder portion of the vehicle belt.

CHECKLIST

  • The child restraint is secure when it moves less than 1” (2.5 cm) front-to-back or side-to-side at the vehicle belt path.
  • Recline angle is correct. The proper recline angle is achieved when the level line on the child restraint is level to the ground.
  • The carry handle is rotated into any locked position.

Securing Your Child

IMPORTANT: Remove bulky coats, jackets and / or bulky sports equipment before putting the child in the child restraint.

  1. Ensure that you have followed all instructions for adjustment of the harness, buckle, and hip slots into the correct position for your child. See page 46.

  2. Loosen the harness by pressing down the harness adjuster lever while pulling both harness straps forward.

  3. Press the tab and pull apart to open the chest clip.

  4. Release the buckle and attach the harness straps to the harness holders.

  5. Place the child in the child restraint as shown. Ensure the child is positioned upright in the child restraint and not slouching. Their bottom and back must rest flat against the child restraint.

  6. Position the harness straps around the child.

  7. Buckle the harness.
    NOTE: After inserting each buckle tongue, a click helps confirm the connection is secure.
    NOTE: Always pull on the harness to ensure it is properly connected.

  8. Check for proper harness height in the closest position below the shoulders and pull any excess slack up to the child’s shoulder area before tightening.

  9. Slowly pull the adjuster strap to tighten the harness around the child.
    NOTE: Snugly adjust the belts provided with this child restraint around your child. A snug strap should not allow any slack. It lies in a relatively straight line without sagging. It does not press on the child’s flesh or push the child’s body into an unnatural position. You should not be able to pinch excess.

  10. Fasten the chest clip and place at armpit level.

CHECKLIST

Before traveling, verify that the:

  • Recline angle is correct.
  • Harness straps are not twisted.
  • Harness is snug.
  • Buckle is fastened.
  • Chest clip is at the child’s armpit level.

Child Restraint Functions

Adjusting the Harness

The child restraint is assembled with the harness in the inner loop.

  • Inner Loop: Maximum 11 lbs (5 kg).
  • Outer Loop: 4 – 30 lbs (1.8kg – 13.6kg)

IMPORTANT: The harness straps should be located in the closest harness height position below the child’s shoulders.

IMPORTANT: Ensure the harness straps are fully secured on the harness yoke.

  1. Loosen the child restraint harness by pressing the harness adjuster release lever and pulling both harness straps forward.

  2. Locate the harness yoke on the back of the child restraint and slide one harness strap off of the yoke.

  3. Pull the harness strap through the cover and head pad from the front of the seat.
    NOTE: Do not remove the comfort pad or chest clip.

  4. Ensure that the harness strap is not twisted and rethread the harness strap through the head pad and then through the appropriate harness height slot in the cover and carrier shell.

  5. Reattach the harness strap to the harness yoke from the back of the seat.

  6. Repeat these steps with the second harness strap and ensure they are at the same slot height.

Adjusting the Buckle Position

The child restraint is assembled with the buckle in the middle slot.

IMPORTANT: Position the buckle in the slot closest to but not under the child.

IMPORTANT: If your child eats and drinks while in the child restraint, you will need to check the buckle periodically and rinse out any accumulated debris (see page 70).

  1. Unbuckle the harness by pressing the red button in the center of the buckle and sliding both harness tongues out of the buckle.
  2. Locate the buckle strap retainer on the bottom of the child restraint and pull away from the seat to loosen.
  3. Turn the buckle strap retainer so that the short side will go through the slot in the carrier shell and cover.
  4. Pull the buckle and belly pad out of the slots in the carrier shell and cover.
  5. Push the retainer through the slot in the cover and carrier shell for the appropriate buckle position.
  6. Pull up on the buckle to ensure that the buckle strap retainer is properly seated.
Adjusting the Hip Slots

The child restraint is assembled with the harness in the outer hip slot.

  • Inner Slot (optional): Maximum 11 lbs (5 kg) ‐ Outer Slot: 4 – 30 lbs (1.8kg – 13.6kg)
  • Hip straps should NOT sit under the child.
  1. Unbuckle the harness by pressing the red button in the center of the buckle and sliding both harness tongues out of the buckle.

  2. Remove carrier shell cover. See page 61.

  3. Locate the hip strap retainer under the cover of the child restraint and pull away from the seat to loosen.

  4. Turn the hip strap retainer so that the short side will go through the slot in the carrier shell.

  5. Push the hip strap retainer through the slot under the carrier, following the current path of the hip strap.

  6. Push the hip strap through the slot in the carrier shell for the appropriate width to fit the child.
    IMPORTANT: Do NOT attempt to use center anchor slot as an adjustment point. This slot is for holding the hip strap retainer secure.

  7. Push the hip strap retainer up through the center anchor slot to secure the hip strap retainer. Repeat for the other side.

  8. Replace carrier shell cover. See page 66.

Carry Handle Position

The carry handle must be adjusted to any locked position for use in a vehicle.
Always use position 1 to carry.
Britax recommends Position 1 for use in a vehicle. The built in ReboundReduceTM helps reduce the rebound of the child restraint in car accidents.
To adjust, slide and hold the carry handle adjuster and rotate the handle to the chosen position.

Head Pad & Infant Positioning Pillow

  1. Head Pad: Provides additional support behind your child to achieve head and neck alignment. To use, tuck behind and around shoulder straps.
  2. Infant Positioning Pillow: The infant positioning pillow is designed to provide better fit and comfort for infants using this child restraint. Allows for a snug fit to be achieved.
    The infant positioning pillow can be used with infants weighing less than 11 lbs (5 kg).

Britax Strollers

IMPORTANT: Not all strollers are compatible with the Willow SC child restraint. For stroller compatibility refer to us.britax.com/support /frequently-asked-questions.

Attaching the Child Restraint to the Stroller

  1. Set the parking brake.
  2. Align the child restraint receivers with the stroller adapters and push onto the frame until a click is heard.
  3. Pull up on both sides of the carrier to verify attachment.

Removing the Child Restraint from the Stroller

  1. Pull and hold the release lever on the back of the child restraint and lift up to remove from stroller.

Using the Lower Anchors

The Lower Anchors offer an alternative to vehicle seat belt installation methods. The figure below shows typical locations for lower anchors in a vehicle. See page 3 for lower connector components on this child seat.

Check your vehicle owner’s manual to learn if it is equipped with lower anchors, the maximum weight rating and information on the lower anchor locations and designated seating positions available for use with this child seat.

Vehicle Compatibility

Vehicle Seating Positions

WARNING!
DO NOT place rear-facing child seat on front seat with air bag. DEATH OR SERIOUS INJURY can occur. Owners of vehicles with front passenger side airbags should refer to their owner’s manual for child restraint installation instructions. The back seat is the safest place for children 12 and under.

  • Some vehicles have no seating positions which are compatible with this child restraint. If in doubt, contact the vehicle manufacturer for assistance. Forward-facing vehicle seats MUST be used with this child restraint. Side-facing or rear-facing seats CANNOT be used. See the diagram below.

This child seat can only be used in the following classes of vehicles: multi- purpose passenger vehicles, passenger cars, or trucks.

Incompatible Vehicle Seat Belts

Vehicle seats and seat belts differ from vehicle to vehicle. Refer to your vehicle owner’s manual for specific information about your vehicle seat belts and their use with child restraints.

WARNING!

The following types of vehicle seat belts are NOT compatible with this child restraint. If any of the belt types listed below are in the chosen seating position, choose another vehicle seating position or check your vehicle owner’s manual for information on installing a child restraint in your vehicle.

  • Lap belts with a sewn-in latch plate that have a retractor that locks only in case of a sudden stop.
  • Lap belts forward ofthe vehicle seat bight.
  • Lap-shoulder belts with top or bottom anchor points on the vehicle door
  • Motorized, automatic vehicle seat belts.

NOTE: This Britax child restraint is not compatible with inflatable lap- shoulder belts.

Care and Maintenance

IMPORTANT: Before each use, check the child restraint and its components to make sure they are in good condition and good working order.

Removing the Cover

  1. Remove the canopy.
  2. Unhook elastic loops from around the canopy knuckles.
  3. Press button on canopy stay.
  4. Lift up the canopy from both sides.
  5. Remove the head pad.
  6. Remove the harness straps and pull off comfort pads. Set aside comfort pads for replacing the cover. See page 46.
  7. Open chest clip.
  8. Unbuckle the harness.
  9. Remove the buckle and belly pad. See page 48.
  10. Detach the two (2) elastic straps and untuck the cover from around the front of the carrier shell.
  11. Undo the elastic bands by the carrier belt guides on both sides.
  12. Pull out the tips of the plastic snaps securing the cover to the carrier shell on both sides.
  13. Undo elastic from around back of seat.
  14. Push harness strap, buckle tongue, and chest clip through the hip anchor slot in the cover. Repeat for the other side.
  15. Pull the seat cover and lift away from the carrier shell.

Replacing the Cover

  1. Pull the harness strap, chest clip, and buckle tongue back through the hip anchor slot in the cover. Repeat for the other side.

  2. Fit the cover onto the top of carrier shell, around head restraint, and tuck into the channel around the carrier shell.

  3. Pull the harness adjuster strap through the cover.

  4. Pull the elastic band around back of carrier shell.

  5. Tuck cover around front of carrier shell and secure the two (2) elastic straps.

  6. Secure plastic snaps at side of carrier shell.

  7. Secure elastic straps near carrier belt guides.

  8. Replace buckle and belly pad. See page 48.

  9. Replace comfort pads and harness straps. See page 46.
    NOTE: Ensure harness straps are not twisted.

  10. Replace head pad.

  11. Replace canopy.

    • Slide elastic loop over canopy knuckle.
    • Slide the canopy into the slot until button pops through the opening.
    • Tuck fabric into channel on back of carrier shell.

Cleaning

Cover/Canopy

  • Refer to product care label for wash instructions.
  • If care label indicates machine washable, always refer to us.britax.com/faqs for important care information.
  • DO NOT bleach or iron.

Harness

  • Sponge clean the harness using warm water and mild soap.
  • Towel dry.
  • DO NOT disassemble the harness, bleach, machine wash, machine dry, or iron.

Buckle

  • Thoroughly rinse the buckle using warm water.
  • Test the buckle by fastening and unfastening until a click is heard after inserting each buckle tongue. If clicks are not heard, repeat the cleaning procedure.
  • Towel dry.
  • DO NOT soak, lubricate, use solvents, soap, or household detergents.

Carrier Shell

  • Sponge clean using warm water and mild soap.
  • Towel dry.
  • DO NOT use abrasive cleaners.

Warranty

This child restraint was manufactured by Britax Child Safety, Inc. (“Britax”). To the extent allowed by law, Britax warrants this product to the original retail purchaser as follows:

LIMITED ONE-YEAR WARRANTY
This product is warranted against defective materials or workmanship for one (1) year from the date of original purchase. Proof of purchase is required for any warranty claims. Your exclusive remedy for this warranty is that Britax will, at its option, provide repair or replacement components to the original purchaser of this product. Britax reserves the right to discontinue or change fabrics, parts, models or products, or to make substitutions.
This warranty does not cover damages that arise from negligence, misuse or use not in accordance with the product instruction. Additionally, Britax products purchased from unauthorized retailers, online auction sites, or as second hand items are not covered under this warranty.
The use of non-Britax covers, inserts, toys, accessories, or tightening devices is not approved by Britax. Their use could cause this child restraint to fail safety standards or not perform as intended in a crash. Their use also may void the Britax warranty.

ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED. Some states do not allow certain exclusions or limitations on warranties, so the above may not apply to you. This warranty gives you specific legal rights, and you may have other rights, which vary from state to state. Arbitration Agreement
MANDATORY ARBITRATION & CLASS ACTION WAIVER (“ARBITRATION AGREEMENT”)
PLEASE READ THIS SECTION CAREFULLY BECAUSE IT AFFECTS YOUR LEGAL RIGHTS, REQUIRES YOU TO ARBITRATE DISPUTES, AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF. Arbitration is a process in which persons with a dispute waive their rights to file a lawsuit and proceed in court and to have a jury trial to resolve their disputes and, instead, agree to submit their disputes to a neutral third person (an “arbitrator”) for a decision. Each party to the dispute has an opportunity to present some evidence to the arbitrator. Pre- arbitration discovery may be limited. Arbitration proceedings are private and less formal than court trials. The arbitrator will issue a final and binding decision resolving the dispute, which may be enforced as a court judgment. A court rarely overturns an arbitrator’s decision. YOU AND BRITAX AGREE THAT ANY DISPUTE BETWEEN US, WHETHER BASED IN CONTRACT, TORT, STATUTE OR OTHERWISE, SHALL BE RESOLVED IN BINDING INDIVIDUAL ARBITRATION. For purposes of this Arbitration Agreement, the word “dispute” and “disputes” are given the broadest possible meaning and include, without limitation, all claims, disputes, and/or controversies arising out of or relating in any way to the relationship between you and Britax (including disputes related to the marketing or sale of Britax products), any provisions in this User Guide or this Arbitration Agreement (including the interpretation and scope of this Arbitration Agreement and the arbitrability of any dispute), and/ or your purchase or use of any products designed, manufactured, distributed, marketed, or sold by Britax. The Federal Arbitration Act (“FAA”) and federal arbitration law apply to this Arbitration Agreement. Notwithstanding the foregoing, you and Britax each agree that you and Britax shall retain the rights to bring an individual suit in small claims court for disputes within the scope of such court’s jurisdiction and/or to bring an individual suit in court to enjoin infringement or other misuse of intellectual property rights. In no way shall the foregoing sentence allow for an action to be brought on a class or collective basis. YOU HAVE THE RIGHT TO OPT OUT OF THIS ARBITRATION AGREEMENT, BUT YOU MUST EXERCISE THIS RIGHT WITHIN THIRTY (30) DAYS OF YOUR PURCHASE OF A BRITAX PRODUCT. If you do not opt out within thirty (30) days of your purchase, then this Arbitration Agreement will apply and you understand and agree that you are waiving your right to maintain other available resolution processes, such as a court action or administrative proceeding, to resolve your dispute with Britax. The arbitration will be conducted confidentially by a single arbitrator and administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules most recently in effect to the extent such rules and procedures do not contradict the express terms of this Arbitration Agreement. If you demand arbitration, then at your request Britax will advance your portion of the expenses associated with the arbitration, including the filing, administrative, hearing and arbitrator’s fees (“Arbitration Fees”) to the extent such Arbitration Fees exceed $200. If Britax demands arbitration, then at your request Britax will advance your portion of the Arbitration Fees. For claims of $10,000 or less, you can choose whether you would like the arbitration carried out based only on documents submitted to the arbitrator or by a hearing in person or by telephone. The arbitration hearing will be conducted in the county of your residence, within 30 miles of such county, or in such place as shall be ordered by the arbitrator. Throughout the arbitration, each party shall bear his, her or its own attorneys’ fees and expenses, including any witness and expert witness fees. The arbitrator shall apply applicable substantive law consistent with the FAA, shall apply statutes of limitation, and shall honor claims of privilege recognized at law. The arbitrator shall decide, with or without a hearing, any motion that is substantially similar to a motion to dismiss for failure to state a claim or a motion for summary judgment. In conducting the arbitration proceeding, the arbitrator shall not apply any federal or state rules of civil procedure or evidence. The arbitrator shall not consolidate the claims of multiple parties unless you and Britax agree to do so. At the timely request of any party, the arbitrator shall provide a written explanation for the award. The arbitrator’s award may be filed with any court having jurisdiction. THIS ARBITRATION AGREEMENT DOES NOT ALLOW CLASS OR COLLECTIVE ARBITRATIONS EVEN IF THE AAA RULES OR PROCEDURES WOULD. IN OTHER WORDS, YOU AND BRITAX EACH AGREE THAT ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE FASHION. THE ARBITRATOR MAY AWARD MONEY OR INJUNCTIVE RELIEF ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF WARRANTED BY THAT PARTY’S INDIVIDUAL CLAIM. NO CLASS, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL OR GENERAL INJUNCTIVE RELIEF THEORIES OF LIABILITY OR PRAYERS FOR RELIEF MAY BE MAINTAINED IN ANY ARBITRATION CONDUCTED PURSUANT TO THIS ARBITRATION AGREEMENT. If the foregoing class action waiver and prohibition against class arbitration is determined to be invalid or unenforceable for any reason, then this entire Arbitration Agreement shall be void. If any portion of this Arbitration Agreement other than the class action waiver and prohibition against class arbitration is deemed to be invalid or unenforceable for any reason, it shall not invalidate the remaining portions of this Arbitration Agreement. If for any reason a dispute proceeds in court rather than in arbitration, you and Britax each waive any right to a jury trial.
