General Terms of Warranty

Coverage. JuiceMatic Plus, Inc. (hereinafter referred to as JuiceMatic) warrants to the original purchaser and user only, that the major, moving parts listed below will be free from defects in material for a period of twelve (12) months from the date of shipment. Included is a labor warranty for a period of twelve (12) months from the date of shipment. JuiceMatic assumes no liability under the warranty for any transportation charges.
Covered Parts. Under this limited warranty, JuiceMatic will repair or exchange, at our option, subject to the conditions, exceptions, and limitations herein, the following parts: motor & drive train, main shaft, bearings and crank;
Motor & Drive Train Warranty. In addition to the warrant contained in Paragraph 1 hereof, but subject to the same exceptions and conditions hereinafter provided, JuiceMatic also agrees to repair or exchange, at our option, at any time during the twelve (12) months from the date of shipment any defective motor or drive assembly, or any pert thereof, if it is proved to our satisfaction to be inoperative due to defects in material or factory workmanship.

If the inoperative motor or drive train assembly or any part thereof is returned, with the transportation charges prepaid to our factory, and it is proved to our satisfaction to be inoperative due to defects in material or factory workmanship, we will repair or ship a replacement unit at “no charge,” transportation charges collect.

Contact us for approval and instructions prior to returning any item covered by this limited warranty.

Electrical equipment, to which the motor and drive train assembly are connected, including but not limited to electric controls such as relays, capacitors and switches, shall not be considered part of the motor assembly. However, these components, if they are proved to our satisfaction to be inoperative due to defects in material or factory workmanship, will also be covered under this warranty for a period of six (6) months from the date of shipment.

DUTIES AND LIABILITIES OF PURCHASER

Labor and Transportation Charges. JuiceMatic assumes no liability for any transportation or labor expense incident to its work under this warranty, such transportation and labor expense is to be paid by Purchaser.
Use and Care of Machine. Purchaser shall only use the machine in accordance with the operator’s manual provided by JuiceMatic and no liability under this Limited
Warranty or otherwise shall attach by reason of a defect caused by negligence, abnormal use, misuse or abuse of said machine, or for any accident that may occur to said machine or any part thereof after said machine has left the factory of JuiceMatic, or for any defect that may arise by placing any part in said machine or machines which has not been manufactured or approved by JuiceMatic

GENERAL CONDITIONS AND EXCEPTIONS TO, LIMITATION ON AND MODIFICAITONS OF, LIABILITY OF COMPANY

Exclusion of Other Warranties. THIS WARRANTY IF IIN LIEU OF ALL OTHER
WARRANTIES, EXPRESSED OR IMPLIED, AND ALL OTHER OBLIGATIONS OR LIABILITIES ON THE PART OF JUICEMATIC, AND DOES NOT ATTACH ANY RESPONSIBILITY UPON US FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND. ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WHICH EXCEED THE AFORESTATED OBLIGATIONS, ARE HEREBY DISCLAIMED BY AND EXCLUDED FROM THIS WARRANTY.
Use and Care of Machine. JuiceMatic shall not be liable for any defect or damage which arises by reason of or is caused by accident, negligence, abnormal use, misuse, abuse, or from any defect that may be caused by the use of any part in the said machine which has not been manufactured or approved by JuiceMatic. JuiceMatic shall not be liable for defect or damage caused by any accident that may occur to send machine or any part thereof after said machine has left the factory of JuiceMatic.
Original Purchaser Only. This Limited Warranty is given solely to the original purchaser and user of the machine and is not transferable. Owner must provide proof of purchase in order to receive any warranty-related services. The original purchaser and user shall be deemed to mean that person, firm, association, or corporation for whom the equipment referred to herein is originally installed for use. We neither assume nor authorize any person, including salesmen for the distributor, or any person not directly employed by JuiceMatic, to assume for us any obligations or liabilities in connection with said machines or any parts thereof. Any such assumption by JuiceMatic shall be valid and binding only if it is in writing and signed by a duly authorized employee of JuiceMatic.
Repair or Replacement of Defective Parts. JuiceMatic obligation under this Limited Warranty is limited to the repair of defective parts at our plant or replacement from JuiceMatic inventory, unless otherwise authorized in writing by the company.
Transportation and Labor Charges. The liability of the company hereunder, except as otherwise provided, does not include or extend to any transportation charges, the same to be the responsibility of Purchaser.
Limitation of Liability. JuiceMatic’s total aggregate liability for all exposures related to the ownership, use, maintenance or operation of the Product for all claims, damages, loss, costs, expenses, interest and penalties, whether arising under this Agreement or an associated purchase order, or in tort, under warranty, negligence, products liability or strict liability rules, or otherwise, shall not exceed two times the cost of the Product (the “Liability Cap”). Notwithstanding the foregoing, the Liability Cap shall be reduced to an amount equal to the cost of the Product if and to the extent that any claim, damage, loss, cost, expense or penalty is related or attributable, in whole or in part, to Purchaser’s breach of the Purchaser’s Undertaking set forth herein.
Excluded Parts. No part, component, or accessory of the machine is included under this Limited Warranty unless specifically listed or described as covered herein.
Advance Replacement. In the event that JuiceMatic ships a replacement part prior to the return of a defective part, payment will by required for said part and credit issued or reimbursement made only if the defective part is returned within thirty (30) days from the replacement date.
Legal Rights. This Limited Warranty gives you specific legal rights. You may have other rights which vary from state to state.
