STANDARD TERMS & CONDITIONS OF SUPPLY
APPLICATION Each sale is made on these terms. Any previous dealings do not affect these terms, nor will any term or condition set out in your order forms or other documents.
TERMS OF PAYMENT If you have a credit account with us, you must pay for goods supplied before the last day of the month after the month in which they were supplied. However, payment will become due immediately if you commit any act of bankruptcy (see the Bankruptcy Act) or you go into external administration (see the Corporations Law). You must pay us any costs (including debt collector’s commission) we incur to recover (or attempt to recover) any overdue payment, or to repossess (or attempt to repossess) any goods. If you do not hold a credit accout with us payment is required prior to releasing goods.
PRICES Our price book is subject to alteration without notice. These terms continue to apply regardless of any discounts which may be agreed to.
GOODS AND SERVICES TAX All prices printed throughout this price book are subject to 10% G.S.T.
DELIVERY Delivery will be to your place of business or to the site address provided by you. The goods are then at your risk, and you are responsible for any loss, damage or deterioration to them. A delivery charge of $60.00 applies for metro areas. Subject to alteration without notice.
ROMPALPA CLAUSE Property in goods supplied will not pass to you until they, and all other goods supplied by us to you, have been paid for in full. If payment is not received once it is due, we may enter any premises where the goods are, or are reasonably thought to be, and repossess them.
CREDITS Goods are not supplied on a sale or return basis. Subject to these terms, once we accept your order, you are obliged to take the goods although property is yet to pass. If we agree to accept any return, it will only be on the basis that the goods are returned in their original condition.
WARRANTY We warrant there is no faulty workmanship and/or materials in the goods for a period of 12 months from delivery. However, our liability is limited to repairing or replacing (which ever option we choose) the faulty goods at no charge to you. Any warranty or condition implied (or other liability put on us) under law is excluded. However, if it cannot lawfully be excluded, then, if allowed, our liability is limited to repairing or replacing (which ever option we choose) faulty goods at no charge to you. Except above, we have no liability to you, and you release us from any costs or loss caused to you by us, including by reason of our negligence, breach of contract or other default.
