MAYFONK VERT Performance Measuring Device

QUICK GUIDE SET UP

Charging your VERT®

  1. Charge your VERT® unit. IMPORTANT: Charge for (2) hours continuous on FIRST charge. The red light will turn green when fully charged. The blue light will stay on even when it is fully charged.
  2. Download the latest version of the VERT® App from the iOS App Store.
  3. Turn on VERT® unit by pressing the button. All interactions for device settings, etc. will be controlled from the VERT® App.
  4. Open the App and follow instructions or go to Settings -> VERT® sensors
  5. To sync your VERT® unit, simply tap “connect” and your VERT® unit is synced. Make sure Bluetooth® is turned on.
  6. Personalize your App: Go to settings under “My Profile” and set up your picture, name and more!
  7. Turn off the VERT® unit after each use by holding down the button for 2-3 seconds.
  8. Visit www.myVERT.com for more app information and best practices!

LIMITED WARRANTY

One Hundred and Eighty (180) Day Limited Hardware Warranty

Subject to the additional terms and conditions set forth below, Mayfonk Athletic, LLC dba VERT (“VERT”) provides this Limited Warranty: Only to the person or entity that originally purchased the VERT device from VERT or from one of its authorized resellers or distributors; and Only for a VERT device purchased and delivered to the end user within the United States. Limited Warranty: VERT warrants the VERT® device (“VERT®”) hardware against defects in materials and workmanship under normal use for a period of one hundred and eighty (180) days from the date of purchase (“Warranty Period”). This Limited Warranty is valid only in the United States for products sold in the United States. A replacement product or part assures the remaining warranty of the original Product or ninety (90) days from the date of replacement or repair, whichever is longer. If VERT determines that the VERT hardware is defective, VERT will either repair the unit or replace the unit with either a new or rebuilt VERT unit, at its option. If VERT determines the Warranty Period has expired or is otherwise not applicable (see Scope of Limitation on Warranty below), we will return the VERT to you. More information about this warranty can be found at www.myvert.com. THE FOREGOING SETS FORTH VERT’S SOLE OBLIGATION AND YOUR EXCLUSIVE REMEDY IN THE EVENT OF ANY BREACH OF THIS LIMITED WARRANTY.

Return and Warranty Service Process

Please access and review the online help resources at www.myvert.com before seeking warranty service or contact us at info@myvert.com attention: warranty service. To return or obtain warranty service for a VERT device, you must first obtain a Return Merchandise Authorization (RMA) number form a Customer Support Representative (CSR) at VERT. Customer Support contact information can be found by visiting www.myvert.com. RMA numbers expire thirty (30) days from issuance. VERT may attempt to troubleshoot a warranty-related problem prior to issuing a RMA number. Please be prepared to provide additional information upon request. Once a RMA number is obtained, you must ship your VERT unit, together with proof of purchase and all accessories, in either the original packaging or packaging affording an equal degree of protection, to the VERT authorized distribution facility identified by the CSR. Failure to return any of the accessories could result in a delay and/or result in an invoice to you or credit to VERT for missing accessories. It is your responsibility to backup any data, pictures, or other materials you may have stored or preserved on the Product.

Important: When emailing for a RMA number, please provide the following information with your request: (a) model number, (b) detailed problem description and reason for return, (c) date of purchase, (d) place of purchase (reseller or online place of purchase), and (e) return shipping address (P.O. boxes are not accepted).

Scope of and Limitation of Warranty

The warranty on the VERT® device is limited to the repair or replacement of defective units as described in the Limited Warranty section above. This warranty does not cover customer training or education, app installation, set up adjustments, or wireless signal reception problems. This warranty also does not cover any issue related to the service provided by your cellular Service Provider, including but not limited to service disruption, changes in service terms, changes in offerings or technical problems. This warranty does not cover damage due to acts of God, accident, misuse, abuse, negligence, commercial use or modification of, or to any part of, your VERT® device. This warranty does not cover damage due to improper operation or maintenance, connection to improper voltage supply or attempted repair by anyone other than a facility authorized by VERT to service your VERT® device. This Limited Warranty applies only to the Product manufactured by or for VERT that can be identified by the “VERT®” trademark, trade name, or logo affixed to original box.

The Limited Warranty does not apply to any (a) VERT products and services other than the Product, (b) non-VERT hardware product, (c) software, even if packaged or sold with the Product or embedded in the Product. Refer to the licenses accompanying the software for details of your rights with respect to its use. VERT does not warrant the operation of the Product will be uninterrupted or error-free. VERT is not responsible for damage arising from failure to follow instructions relating to the Product’s use.

Implied Warranties

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, THIS WARRANTY AND THE REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED. VERT DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. INSOFAR AS ANY WARRANTIES CANNOT BE DISCLAIMED, VERT LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT VERT’S OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW.

Limitation of Liability: EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, VERT SHALL NOT BE LIABLE FOR ANY DIRECT, INCIDENTIAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY

Governing Law and Arbitration: This Limited Warranty shall be governed by the laws of the State of Florida without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction. Any claim or dispute in connection with this Limited Warranty shall be resolved in a cost-effective manner through binding non-appearance- based arbitration. The arbitration shall be initiated through an established alternative dispute resolution provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on writen submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. If the foregoing arbitration clause does apply for any reason, you agree to submit to the personal jurisdiction of the state courts located within Broward County of Florida for the purpose of litigating all such claims or disputes, which courts shall have exclusive jurisdiction of such claims or disputes. Notwithstanding the foregoing, VERT may seek injunctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.
